emissions the City is concerned about by referring to State and Federal guidelines as they <br />exist today. MPCA and EPA are in the process of revising their guidelines and Ramsey's <br />ordinance would then be subject to amendment within one year. Of more concern to the <br />City is toxic emissions and anything the City would have written into the ordinance along <br />those lines would have been the burden of the City to prove if challenged. It was thought <br />by Staff that a better option would be to adopt a generalized ordinance which is before the <br />Commission now for review. This particular ordinance could be challenged by someone <br />seriously considering placing an incinerator in Ramsey and if it were striken down, the City <br />would still have the conditional use process to fall back on. In addition, the ordinance as <br />written would discourage somebody that is taking a first look at a number of communities <br />for placement of an incinerator. Basically, the ordinance indicates that there is no burning <br />of solid, hazardous, medical or special wastes by incinerator in Ramsey. <br /> <br />Commissioner Deemer stated that he does not agree in theory with an ordinance that most <br />likely will not stand up in court. Commissioner Deemer stated that one loop hole in the <br />ordinance is that it exempts existing incinerators. <br /> <br />Mr. Otto stated that it may be possible for the proposed ordinance to prohibit existing <br />incinerators from burning contract waste. In addition, with the proposed standards EPA is <br />working on, 85% of the incinerators in the Country are probably going to have to be <br />retrofitted. <br /> <br />Commissioner Deemer suggested that the City have a separate ordinance requiring existing <br />incinerators to be monitored and thereby create an economic disincentive to their continued <br />llse. <br /> <br />Motion by Commissioner Bawden and seconded by Commissioner LaDue to recommend <br />that City Council adopt the proposed amendment to the Zoning Ordinance regarding waste <br />incineration. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, <br />Bawden and Deemer. Voting No: None. Absent: Commissioners Terry and Shumway. <br /> <br />Case #8: Review Amendments To The City Code, Zoning And <br /> Subdivision Ordinance: <br /> <br />A. Required Information On Certificate Of Survey - <br /> <br />The Commission proceeded to review what is proposed to be required on certificates of <br />survey in the MUSA area and in the Rural aarea. <br /> <br />Chairman Zimmerman suggested that City Staff obtain price quotes from surveyors <br />regarding the cost to provide what is proposed to be required on certificates of survey. <br /> <br />Chairman Zimmerman suggested that the draft Information Required On Certificate Of <br />Survey be rewritten to categorize the requirements, and thereby simplify the process for <br />the property owners by indicating which categories are to be addressed in each particular <br />case. <br /> <br />Planning and Zoning Commission/September 19, 1989 <br /> Page 3 of 7 <br /> <br /> <br />
