Councilmember Cook introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #03-10-277 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0654 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FROM DAVID AND GAlL HENNEK <br />FOR AN OVERSIZED DETACHED ACCESSORY BUILDING ON PROPERTIES <br />LOCATED OUTSIDE THE METROPOLITAN URBAN SERVICE AREA. <br /> <br /> WHEREAS, David and Gail Hennek, hereinafter referred to as the "Applicant," has <br />properly applied for a Conditional Use Permit for an oversized detached accessory building on <br />properties located outside the Metropolitan Urban Service Area (MUSA) on the property <br />generally known as 16100 Wolfram St NW and legally described as follows: <br /> <br />Lot 1, Block 2, Oakwood Hills, Anoka County, Minnesota <br /> <br />("Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on October 2, 2003, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />by reference. <br /> <br />2. That the Subject Property is zoned R-1 Rural Developing and is located outside the <br /> Metropolitan Urban Service Area (MUSA). <br /> <br />3. That the Subject Property is bordered to the east, west, and south by properties zoned R-1 <br /> Rural Developing and to the north by property zoned Public/Quasi-Public. <br /> <br />4. That the Subject Property is approximately 1.12 acres in size (49,310 square feet). <br /> <br />5. That City Code restricts the Subject Property to a total of 1,664 square feet of accessory <br /> building space. <br /> <br />That the Applicant has a primary garage totaling 704 square feet; the proposed accessory <br />building is 1,408 square feet in size; resulting in a total of 2,112 square feet of accessory <br />building space on the Subject Property. The net result is a 448 square foot overage in the <br />1,664 square foot limit. <br /> <br />7. That the proposed structure will not exceed the maximum height restriction of sixteen (16) <br /> feet as measured at the mean gable roof height. <br /> <br /> <br />
