WHEREAS, on June 25, 2003, the Planning Commission reviewed the preliminary plat and recommended approval of the preliminary plat subject to the compliance with Staff Review Letter dated May 30, 2003, Revised June 23, 2003; and WHEREAS, on July 22, 2003, the City Council reviewed the preliminary plat for Town Center Gardens subject to compliance with City Staff Review Letter dated May 30, 2003, Revised June 23, 2003, Revised July 18, 2003; and WHEREAS, on August 13, 2003, the DEVELOPER submitted a final grading plan dated August 12, 2003 and prepared by Pioneer Engineering; and WHEREAS, on September 23, 2003, the CITY approved the grading plan for the Subject Property and entered into an agreement with the DEVELOPER regarding such grading work. WHEREAS, the final plat and construction plans were submitted to the CITY September 11, 2003; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the Ramsey City Council hereby grants final plat approval to Town Center Gardens in accordance with relevant City Codes and Staff Review Letter dated October 10, 2003. 2) That the Developer shall enter into a Development Agreement with the City for the development of the Subject Property. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Elvig, and upon vote being taken thereon, the following voted in favor thereofi Mayor Gamec Councilmember Councilmember Councilmember Councilmember Councilmember Councilmember and the following voted None and the following abstained: None Kurak Elvig Cook Pearson Strommen Zimmerman against the same: RESOLUTION #03-10-282 Page 2 of 3
