Councilmember Bawden stated that he disagrees with Item ~4 of the proposed
resolution which requires a minimum of 6,000 square feet of merchandise
floor space as existing facilities are required by ordinance to have only
4,000 square feet.

Councilmember Bawden referred to Item Y~'s 1 and 2 of the proposed
resolution (requiring location to be urban area and facility to be served
by public utilities) and disagreed with proprietary specifications that
dictate where a business can be located; appropriate business locations
should be determined by zoning and be a decision of the owner.

Brad Dahl - 6015 Radium Circle - Stated that he agrees with Councilmember
Bawden's comments and requested that Council not limit the additional off-
~ale liquor license to the urbzn area.

Bradley Kern - 17940 Uranium Street - Stated that he feels the intent to
assure a certain level of investment in a facility by requiring a minimum
of 6,000 square feet is met with the existing 4,000 square foot
requirement; that anyone who currently holds a liquor license should not be
eligible for another license as it leads to monopolizing and loss of
competitiveness.

Mr. Dick Muller - Stated that restricting the additional off-sale license
to the urban area is unfair to owners of commercial property in the rural
district.

Councilmember DeLuca stated that requiring a minimum of 4,000 square feet
is reasonable; restricting issuance of the license in the urban area is
an extension of Council's policy to encourage development in the urbar
area.

Mayor Reimann noted that restricting the location of a business may be it's
dc~,nfall as the urban area may not be a viable location at this time.

Mr. Hartley noted that the recipient of the addtional off-sale liquor
license can also be determined by random selection rather than by
establishing criteria.

Councilmember Sorteberg noted that in the past the City has not restricted
general business deve!opmen= to the sewer and water area, only high water
usage businesses.

Motion by Councilmember Serteberg and seconded by Councilmember Pearson
to adopt Resolution ~88-241, amended as follows, establishing criteria for
the issuance of an off-sale liquor license and directing City Staff to
prepare an ordinance for same:

a. Eliminate Item f~2 of the criteria requiring the facility to be
served by public se~er and water.

b. Amend Stem f~4 cf the criteria to require 4,000 square feet of
merchandise floor space.

City Council/December 27, 1988
