Councilmcmber Pearson stated that he made the comment regarding selective enforcement <br />of the horse ordinance. <br /> <br />Mayor Reimann stated that Council is willing to listen to the horse community regarding <br />suggestions for a better horse ordinance. <br /> <br />Mr. Hendriksen stated that an amendment to the horse ordinance was forwarded to Council <br />and denied. In Ms. Willaims' case, Council is being asked to grant a conditional use <br />permit to go beyond what ordinance allows based on what is happening in the City versus <br />what the ordinance allows. <br /> <br />Mayor Reimann stated that Council is obligated to enforcing the current ordinance. <br />Councilmember DeLuca stated that basically, horses are not a compatible in Residential <br />zoning; the horse community should propose zoning districts where horses would be <br />allowed. <br /> <br />Commissioner Hendriksen replied that horses are appropriate in Rural Residential zoning. <br /> <br />Ms. Williams stated that her neihbors have interfered with her pursuit of happiness and <br />violated her constitutional rights through various ways; a court judge has ordered the <br />harassmenti to stop. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson to adopt <br />Findings of Fact #0244, as amended, relating to Ms. Rhonda Williams and Mr. Philip <br />Swiggum's request for a conditional use permit to maintain a horse hobby farm. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson. Voting No: None. <br /> <br />Motion by Mayor Reimann and seconded by Councilmember Peterson to deny Ms. <br />Williams' and Mr. Swiggum's request for a conditional use permit to maintain a horse <br />hobby farm. <br /> <br />Further Discussion: Councilmember Peterson stated that it appears the request will be <br />denied but perhaps it can be followed up with a consensus that the City will seriously <br />consider revising it's current horse ordinance and replacing it with one that is enforceable. <br />Mayor Reimann a~eed that the points brought out in tonight's discussion are valid. Mr. <br />Hendriksen noted that the Planning Commission spent a great deal of time on the proposed <br />horse ordinance amendment that was denied by Council in 1988; Anoka County has the <br />second largest horse population in the U.S. Ms. Frolik noted that the Council again <br />reviewed the proposed horse ordinance amendment on March 2 and requested that the <br />Planning Commission modify the acreage requirements. Councilmember Pearson stated <br />that he s.vrnpathizes with Ms. Williams but the area is too heavily developed to deviate from <br />what ordinance requires. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson. Voting No: None. <br /> <br />Ms. Williams inquired as to why Council did not take into consideration the fact that her <br />next door neighbors did not object to her request to keep 5 horses on her property. <br /> <br />City Council/March 14, 1989 <br /> Page 9 of 13 <br /> <br /> <br />
