The discussion for unlimited off-sale licenses included increasing tax base,
promoting free enterprise and the Police ChieFs indication that off-sale liquor stores are not
a policing problem. The discussion for limiting off-sale liquor licenses included protection
of investment of those licensed under the existing ordinance and following the concept of
one off-sale facility per 5,000 population. The majority consensus was to remain with 3
off-sale liquor licenses as proposed in the ordinance.

Council inquired about limiting the issuance of the off-sale liquor licenses to community
residents and Mr. Goodrich replied that such a term is included in the League of Minnesota
Cities model ordinance. This term could be successfully challenged in court, but to date
has not been.

Motion by Councilmember Cich and seconded by Councilmember Pearson to adopt
Ordinance #89-8 which is an ordinance licensing and regulating the sale of off-sale
intoxicating liquor.

Ci~, Council/April 25, 1989
