Mrs. Tripp asked why they were allowed ~o petition again instead of having to wait for a period of <br />on~ yeaT. <br /> <br />City Administrator David Hartley explained that this improvement project was petitioned by fl~e <br />public and not by the CID', which could have been interpreted as unlawful. The lRamsey City <br />Council may accept and process, petitions by the public. <br /> <br />Mrs. Tripp stated that she felt that it can't be considered for one year because of the way it is stated <br />in the City Charter (Chapter 8). <br /> <br />David Hartle3' stated that there is a level of uncertainty as the City Charter still continues to be <br />interpreted, and that we would seriously look at questions from the citizens. <br /> <br />Bernard Wurm - 15354 Hematite Street Northwest - Mr. Wurm asked if it would be less expensive <br />per benefitting property, (as w/th a larger project) to spread out the costs ox, et a larger nunmer of <br />lots. <br /> <br />Mr. Raatikka told Mr. Wurm that it is, prop(:rtionally less per lot for a larger project. <br /> <br />Mayor GaD' Reimann explained that the City of Ramsey encourages the grouping of projects such <br />as this to economize. <br /> <br />Mrs. ". ~ipp asked why people in the area could not wait for the proposed 153rd Avenue Project to go <br />through and spread out the cost. <br /> <br />Mayor Reimann asked Public Works Supervisor Merle Mevissen how much maintenance that <br />area of Hematite Street requires. <br /> <br />Mr. Mexdssen replied that they had to bring in Class 5 gravel every year in addition to the normal <br />maintenance practices. <br /> <br />Mr. Gobernatz stated that he was told by his attorneys that to proceed with this project would be <br />illegal before the one year waiting period was completed and that if the process was be~man, he <br />would initiate a lawsuit. <br /> <br />Dax4d Hartley explained the purpose of a public hearing and also that Council could not take action <br />for at least 60 days. <br /> <br />AD JOLrRN%IENT <br /> <br />Moz]on by Councilmember Pearson and seconded by Councilmember DeLuca to adjourn the <br />hearing. <br /> <br />Motion carried. Voting Yes: Mayor !Reimann, Councilmembers Pearson, DeLuca, and Peterson. <br />Voting No: None.
