l?0.015H lqON.-CONFOPd4IN¢ USES INTENT: It is the intent of this chapter to permit an existing non-conforming use to contibue until it is removed, but not to encourage its use or expansion. Any structure and/or use existing upon the effective date of the adoption of this chapter may be continued as long as it remains otherwise lawful provided that it meets the following provisions. 1. No such use and/or structure shall be expanded or enlarged except in conformity with the provisions of this chapter. 2. A non-conforming use of a structure which has been discontinued for a period of twelve (12) months shall not be re-established and any further use shall be in conformity with the regulations of this chapter. A non-conforming structure which is damaged by any cause to the extent of more than fifty percent (50%) of its market value as determined by the current records of the City Assessor shall not be restored except in conformity with the regulations of this chapter. Normal maintenance of a non-conforming use and/or structure is permitted. Maintenance may include necessary non-structural repairs and incidental alterations which do not enlarge or intensify the non- conforming use. Buildings meeting City standards on setbacks as listed in Section 170.016 shall in no case be considered non- conforming for the setbacks. When any lawful non-conforming use has been changed to a conforming use, it shall not thereafter be changed to any unlawful non-conforming use. The City Administrator shall conduct an inspection on a periodic basis of all non-conforming uses and report the findings to the Planning and Zoning Commission and the City Council within sixty (60) days of his inspection for their information. 34
