Case #1 <br />UPDATE ON RIVER'S BEND PARK SOUTH DEVELOPMENT <br /> IMPROVEMENT PROJECT 89-1 <br /> <br />By: Merland Otto <br /> <br />city Council approved advertising for bids on February 28, 1989 for <br />the above referenced project. Bid ads have been published with <br />bids originally scheduled to be received March 27. Upon <br />recommendation of staff, the City Council authorized the extension <br />of the bid date to April 10, 1989. <br /> <br />Plans are out for bids based ~n an access road alignment which the <br />Corp of Engineers, USFWS and DNR have indicated they would approve. <br />The County has not approved this alignment but may be required by <br />the review agencies to provide access across the 116 right-of-way <br />in order to receive approval of the 116 bridge project. <br /> <br />At a meeting with County Highway engineers, County staff indicated <br />that an access road looped under the bridge could be accommodated. <br />The alternative alignment of the access road was then submitted to <br />DNR and the Corps of Engineers. A copy of DNR's review letter is <br />attached. The Corp of Engineers have not yet transmitted their <br />formal comments. We have, however, been in frequent contact with <br />them regarding this issue. They have indicated that it would be <br />unlikely that they would approve the alternative alignment due to <br />impacts on wetlands created by fill requirements and subsequent <br />impacts on wildlife. <br /> <br />The alternate alignment if ultimately approved, encroaches <br />approximately 20 to 30 feet into the 75' setback requirement for <br />pavement and structures from the Rum River. A variance allowing <br />construction would thus be required for the alternative alignment. <br /> <br />Recommendation: <br /> <br />That the Board of Adjustment grant a variance allowing construction <br />of a paved access road within the setback requirements of the Rum <br />River. <br /> <br />Board of Adjustment Action: <br /> <br />Motion to approve/deny a variance from the 75' setback requirement <br />allowing a paved access road to be constructed within 50' of the <br />Rum River. <br /> <br />Review Checklist: <br /> <br />city Administrator X <br />city Attorney X <br />city Engineer X <br />Community Development Dir.
