in an area zonned to permit such a land use. CONDITIONS GOVERNING LICENSE ISSUANCE The following conditions govern issuance of a license pursuant to this section: 1. Every license shall be granted subject to the provisions c~ this section and of any other applicable ordinance or law, including Chapter 340A of Minnesota Statutes. 2. The license shall be posted in a conspicuous place in the licensed premises at ail times. 3. Every licensee shall be responsible for tile conduct of the licensee's place of business and for the conditions of sobriely and crder in the place of business and on the premises. 4. No 'on sale' licensee shall sell alcoholic beverage "off sale'. 5. No license shall be effective beyond the building space shown in the license application for such license. 6. No person under eighteen (18) years of age shall be employed in any rooms constituting the place in which alcoholic beverages are sold at retail 'on sale', except that persons under eighteen (18) years ot age may be employed to perform the duties of a bus boy or dish washing services in hotels or restaurants licensed under the provisions of this section. 7. No alcoholic beverage shall be sold or furnished or delivered to any intoxicated person, to any habitual drunkard, to any person under 21 years of age or to any person !.o whom sale is prohibited by state law. 8. Nc licensee or employees of a licensee shall keep, possess, or operate or permit the or operation of any slot machine, dice, or any gambling device or apparatus on the licensed premises, or in any room adjoining the licensed premises, nor shall any such person permit any gambling therein, except as authorized by the State of Minnesota charilabie gambling law. 9. No licensee shall knowingly permit the licensed premises or any room in those premises, or any adjoining building directly or indirectly under the licensee's control to be used as a resort for prostitutes. 10. Any police officer, health officer, sanitarian, building inspector, or any property designmed officer or employee of the City shall have the right to enter, inspect and search the premises of the licensee during business hours without a warrant; however, in the event an occupant of a room in the hotel portion of the licensed premises shall refuse enlry to any poiice officer, health officer, sanitarian, building inspector, or any properly designated officer or employee of the City, on the basis that the time of the inspectio~ is not a reasonable one and does not in fact allow the representative of the City e~'~try to such poniun of the premises, then ths representative of the City shall request a search warrant from a court of appropriate jurisdiction. 11. No on sale liquor establishment shall display liquor to the public during hours when the sale of liquor is prohibited by this chapter and no on sale licensee shall sell alcoholic beverage off sale. 12. No licensee shall apply for or possess a Federal Wholesale Retail Liquor Dealer's special tax stamp or a federal gambling stamp. 13. No equipment or fixture in any licensed place shall be owned in whole or in part by any manufacturer or distiller of alcoholic beverage, except such as shall be expressly permitted by state law. 14. The retail sale for beverage purposes of ethyl alcohol or neutral spirits, or substitutes therefore, possessing the taste, aroma, and characteristics generally attributed to ethyl alcohol or neutral spirits, as such, is hereby prohibited. Nothing in this paragraph shall be construed to prohibit the sale of other products obtained by the use of ethyl alcohol or neutral spirits as defined in U.S. Treasury Department, Bureau of Internal Revenue, Regulations 125, Article II, Standards of Identity for Distilled Spirits. 15. The business records of the licensee, including federal and state income tax returns, shall be available for inspection by the City Council or other duly authorized representative of the City at all reasonable times. 7
