JAN-24-'89 TUE 17:50 ID:CITY OF EAGAN TEL N0:454 8100 ~452 P04/06 <br /> <br />To be e11gtble for park dedication credit, land dedicated is to <br />be located outside of drainways, flood plains or pondtng areas <br />after the site has been developed. Grades exceeding 12% or are <br />unsuitable for parks development shall be considered for partial <br />dedication. <br /> <br />Where pondtng has been determined to have a park function, credit <br />wtll be given at a rate of 50% of the pond and adjoining land <br />area below the hlgh water level; a mtntmum of 70% of land above <br />the high water mark shall be dedicated before pond credit is <br />granted. Other City park dedication policies relattng to pond <br />dedication must also be complted with. <br /> <br />In those cases where subdividers and developers of land provide <br />significant amenities such as, but not limited to swimming 'pools, <br />tennis courts, handball courts, ball fields, etc, within the <br />development for the benefit of those residing or worktng theretn, <br />and where, in the judgment of the Director of Parks and <br />Recreation, such amenities significantly reduce the demands for <br />public recreational facilities to serve the development, the <br />Director may recommend to the Advisory Parks and Recreation <br />Commission that the amount of land to be dedicated for park, <br />playground and public open space (or cash contributions in lieu <br />of such dedication) be reduced by an amount not to exceed 25% of <br />the amount calculated under paragraph 2 above. <br /> <br />The Ctty, upon review, may determine that the developer shall <br />create and maintain some form of on-site recreation use by the <br />site residents such as tot lots and open play space. This <br />requirement may be in addition to the land or cash dedication <br />requirement. <br /> <br />~ASH DEDICATION <br /> <br />If, at the option of the City, it is determined that a cash dedication <br />shall be made, said cash shall be placed in a special fund for Parks <br />and Recreation use and deposited by the developer wlth the City prior <br />to final plat approval. <br /> <br />The City Council, upon review and recommendation of the Advisory Parks <br />and Recreation Commission, shall annually determine by resolution the <br />park cash dedication fee per residential unit. Said fee shall be <br />determined by the average market value of undeveloped residential <br />property by zoning classification, served by major City utilities, <br />divided by the number of units per acre, which shall provide the <br />equivalency of twelve acres per thousand population. <br /> <br /> <br />
