By: 153RD AVE h~ E PdkILROAD CROSSING AGREEF~EA"~ Pete Raatikka, City Engineer Background: I have recently received agreements for the railroad at grade crossing 153rd Avenue Northwest and the Puma Street crossing in the city. The agreement for =he proposed 153rd Avenue crossing specifies the City's responsibilities and the work to be perfo~--med by the railroad at the City's e>~ense . This agreement also calls for a pa}~ent of $1,000 for an easement for right-of-way pu_~poses and barricading Puma Street at the intersection of !53rd Avenue N.W. The Puma Street agreement would convert the existing crossing from a public crossing to a private crossing. This agreement calls for a $!00 fee for the initial five year period. Enclosed are the following items for your info~mation: a) Two letters from Burlington Northern Railroad addressed to myself and dated January 10, 1989. b) Construction and Maintenance Agreement for the new crossing. P_=va~e Roadway and crossing Agreement. I have submitted the agreements to the City Attorney and the Mn/DOT District 5 State Aid Engineer for review. Mn/DOT has to approve the agreement in order for the City to obtain State Aid Funds for the construction. Recommendation: i would recommend that the city Council authorize the Mayor and city Administrator to sign the agreements and submit the re_cuired pa~ents upon review and approval of the Agreements by the City Attorney and Mn/DOT. Council Action: Motion to: Authorize the Mayor and City Administrator to enter into the Construction and ~aintenance Agreement and the Private Roadway and Crossing Agreement with Burlington Northern Railroad and submit the re~aired payments subject to the approval by the City Attorney and Mn/DOT.
