Install private crossing signs at Puma St. <br /> <br /> V <br /> <br /> The current estimated cost of the various items of work, except <br />flagging and other protective services and devices, to be performed by <br />Railroad under this agreement is shown on the estimate attached hereto and <br />marked Exhibit "B", anu by this reference made a part hereof. Railroad will <br />submit progress bills to City on the basis of the actual percentage of <br />completion of the various cost reimbursable items detailed on Exhibit "B". <br />Final bill will be on the basis of actual cost ascertained in accordance with <br />the provisions of FHPN 1-4-3 and other pertinent instructions issued by the <br />Federal Highway Administration, Department of Transportation. <br /> <br /> If Railroad enters into a contract or agreement with a contractor to <br />perform any of the work which Railroad is required to perform under the terms <br />of this agreement by reason of the construction of the City's project, <br />Railroad, for itself, its assigns and successors in interest, agrees that it <br />will not discriminate in the choice of contractors and will include all the <br />non-discrimination provisions set forth in Exhibit "C", attached hereto and by <br />this reference made a part hereof, in any such contract or agreement. <br /> <br /> VI <br /> <br /> All work provioed to be done by City or its contractor on Railroad's <br />right of way or in the vicinity of Railroad's tracks shall be done in a manner <br />satisfactory to Railroad and shall be performed at such time and in such <br />manner as not to interfere unnecessarily with the movement of trains or <br />tr&fflc upon the tracks of Railroad, City will require its contractor to use <br />all care and precaution necessary to avoid accident or damage to, or <br />interference with, Railroad's tracks or trains and to notify Railroad's Lakes <br />Division General Manager a sufficient time in advanc~ whenever the contractor <br />is about to perform work on or adjacent to Railroad's right of way and tracks <br />to enable Railroad to furnish flagging and such other protective services and <br />devices as in Railroad's judgment may be necessary to insure safety of <br /> <br />-3- <br /> <br /> <br />
