If said highway-railroad grade crossing and signals cannot, through <br />age. be maintained or require replacement by virtue of their obsolescence, <br />then the cost of installation of replacement highway-railroad ~e cros~ <br />and signals shall be borne by the City unless federal funds may be available <br />at the time such replacement becomes necessary. <br /> <br /> ×I <br /> <br /> If, for any reason, said signals shall no longer be required at <br />the said grade crossing, the Railroad, on the approval of the City, may re~ove <br />saiU signals and credit the City with the salvage v~lue less cost of removal. <br />In the event that either railroad or highway improvement will necessitate a <br />rearrangement or relocation or alternation of the crossing or the signals at <br />s~id crossing, the City shall bear the entire cost. <br /> <br /> ×II <br /> <br /> In case said highway shall at any time cease to be used as a <br />public road or shall by operation of law become vacated or abandoned, the <br />rights and benefits to the City under this agreement shall immediately cease <br />and the Railroad shall be entitled to repossess the land to which it has <br />executed easements and permits to the City and to use the same thereafter as <br />if this agreement had never been executed, ~ithout the necessity of any <br />further legal proceedings. <br /> <br /> X!!I <br /> <br /> This agreement shall inure to the benefit of and be binding upon the <br />parties hereto, their successors and assigns. <br /> <br /> IK ~IT~£SS ~EREOF, the parties have caused this agreement to be <br />executed the day and year first hereinabove written. <br /> <br />BURLINGTON NORTHERN RAILROAD COMPANY <br /> <br />Httness <br /> <br />-6- <br /> <br /> <br />
