commenced pursuant to the provisions of Chapter 278, Minnesota Statutes, questioning the amount or validity of such taxes, the Council may, on application by the licensee, waive strict compliance with this provision; no waiver may be granted, however, for taxes or any portion thereof which remain unpaid for a period exceeding one (1) year after becoming due. 3. No license shall be granted to a foreign corporation. 4. No license shall be granted for any place which has a common entrance or exit between any two (2) establishments, except that a public concourse or public lobby shall not be construed as a common entrance or exit. 5. No on sale license shall be granted for a restaurant which does not comply in all respects with the definition of a restaurant as contained in Section 130.051, nor to any restaurant which does not have a total market value, including land, building and equipment, of at least Two Hundred Thousand Dollars ($200,000.00) as appraised by the City Assessor and based upon current valuations. 6. No on sale license shall be granted unless the proposed business is located in an area zoned to permit such a land use. CONDITIONS GOVERNING LICENS ISSUANCE The following conditions govern issuance of a license pursuant to this section: 1. Every license shall be granted subject to the provisions of this section and of any other applicable ordinance or law, including Chapter 340A of Minnesota Statutes. 2. The license shall be posted in a conspicuous place in the licensed premises at all times. 3. Every licensee shall be responsible for the conduct of the licensee's place of business and for the conditions of sobriety and order in the place of business and on the premises. 4. No "on safe" licensee shall sell alcoholic beverage "off sale". 5. No license shall be effective beyond the building space shown in the license application for such license. 6. No person under eighteen (18) years of age shall be employed in any rooms constituting the place in which alcoholic beverages are sold at retail "on sale", except that persons under eighteen (18) years of age may be employed to perform the duties of a bus boy or dish washing services in hotels or restaurants licensed under the provisions of this section. 7. No alcoholic beverage shall be sold or furnished or delivered to any intoxicated person, to any habitual drunkard, to any person under twenty-one (21) years of age or to any person to whom sale is prohibited by state law. 8. No licensee or employees of a licensee shall keep, possess, or operate or permit the or operation of any slot machine, dice, or any gambling device or apparatus on the licensed premises, or in any room adjoining the licensed premises, nor shall any such person permit any gambling therein, except as authorized by the State of Minnesota charitable gambling law. 9. No licensee shall knowingly permit the licensed premises or any room in those premises, or any adjoining building directly or indirectly under the licensee's control, to be used as a resort for prostitutes. 10. Any police officer, health officer, sanitarian, building inspector, or any property designated officer or employee of the City shall have the right to enter, inspect and search the premises of the licensee during business hours without a warrant; however, in the event an occupant of a room in the hotel portion of the licensed premises shall refuse entry to any police officer, health officer, sanitarian, building inspector, or any properly designated officer or employee of the City, on the basis that the time of the inspection is not a reasonable one and does not in fact allow the representative of the City entry to such portion of the premises, then the representative of the City shall request a search warrant from a court of appropriate jurisdiction. 11. No on sale liquor establishment shall display liquor to the public during hours when the sale of liquor is prohibited by this chapter and no on sale licensee shall sell alcoholic 7
