3o <br /> <br /> c) after 1:00 a.m. on Sundays, except as <br /> provided by subdivision 3; <br /> d) between 8:00 p.m. on December 24 and <br /> 8:00 a.m. on December 25, except as <br /> provided by subdivision 3. <br /> Special Sunday "on sale" liquor licenses. <br /> Hotels, restaurants, clubs, and bowling <br /> centers (as per State law) having special <br /> Sunday "on sale" liquor licenses may serve <br /> alcoholic beverages in conjunction witthe <br /> sale of food between the hours of 10:00 <br /> a.m. and 12:00 midnight on Sunday, provided <br /> the licensee is in conformance with the <br /> Minnesota Clean Air Act, notwithstanding <br /> the provisions of Paragraph 1 above. <br />Except as otherwise herein provided, all "on <br />sale" establishments, bottle clubs and public <br />drinking places shall be closed to the public <br />not later than one-half (1/2) hour after the <br />required time for stopping sales, until the <br />time herein provided as permissible for <br />sales, consumption or display. No persons <br />other than employees shall be permitted <br />within such establishments during the closed <br />periods. All such "on sale" licensees may <br />keep licensed premises open at times when <br />the sale of intoxicating and non-alcoholic <br />.beverage is prohibited for sale of food or <br />recreational activity, provided such licensees <br />shall lock, or in other manner secure, all <br />facilities or equipment for the serving of <br />such liquor starting not later than 1:00 a.m. <br />until the time herein provided as permissible <br />for sales, consumption or display. All <br />public entrances to premises open after <br />1:00 a.m. shall remain open and unlocked <br />during all limes when said premises have <br />customers therein. No licensee who elects <br />to remain open after 1:00 a.m. shall permit <br />any person to consume or display any liquor <br />in any container, including glasses, in the <br />premises after 1:30 a.m. and until the time <br />herein provided as permissible for sales, <br />consumption or display. <br /> <br />RESTRICTIONS INVOLVING SALE TO <br />MINORS <br />1. No person shall give, sell, procure or <br /> purchase an alcoholic beverage to or for any <br /> person 1o whom the sale of alcoholic <br /> beverage is forbidden by law; nor shall a <br /> <br /> licensee, or his agent or employee, permit <br /> such person to be furnished or consume any <br /> such alcoholic beverage on the licensed <br /> premises. <br /> 2. No person under twenty-one (21) years of <br /> age shall misrepresent his age for the <br /> purpose of obtaining intoxicating liquor nor <br /> shall such person enter any premises <br /> licensed for the retail sale of an alcoholic <br /> beverage for the purpose of purchasing or <br /> having served or delivered to such person <br /> for consuming any such alcoholic beverage, <br /> nor shall any person purchase, attempt to <br /> purchase, consume, or have another person <br /> purchase for on that person's behalf any <br /> alcoholic beverage. <br /> 3. No person under twenty-one (21) years of <br /> age shall receive delivery of an alcoholic <br /> beverage. <br /> 4. No person shall induce a person under the <br /> age of twenty-one (21) years to purchase <br /> or procure or obtain an alcoholic beverage. <br /> 5. Any person who may appear to the licensee, <br /> the licensee's employees or agents, to be <br /> under the age of twenty-one (21) shall, upon <br /> demand of the licensee, an employee or <br /> agent, produce and permit to be examined <br /> an identification certificate issued by any <br /> Administrator of District Court in the State <br /> of Minnesota pursuant to Section 626.311 <br /> through 626.319, Minnesota Statutes. <br /> 6. In every prosecution for a violation of the <br /> provisions of this ordinance relating to the <br /> sale or furnishing of alcoholic beverage to <br /> persons under the age of twenty-one (21) <br /> years, and in every proceeding before the <br /> City Council with respect thereto, the fact <br /> that the minor involved has obtained and <br /> presented to the licensee, an employee or <br /> agent, a verified identification card issued <br /> by the Clerk of District Court in the State <br /> of Minnesota, from which it appears that <br /> said person was twenty-one (21) years of <br /> age and was regularly issued such <br /> identification card, shall be prima facie <br /> evidence that the licensee, the agent or <br /> employee is not guilty of a violation of such <br /> a provision and shall be conclusive evidence <br /> that a violation, if one has occurred, was <br /> not willful or intentional. <br />7.
