INTOXICATING LIQUOR FOR <br /> ON-SALE <br /> <br />AN ORDINANCE LICENSING AND <br />REGULATING THE SALE AND <br />CONSUMPTION OF "ON-SALE" <br />INTOXICATING LIQUOR, REPEALING <br />INCONSISTENT ORDINANCES, AND <br />PROVIDING A PENALTY FOR VIOLATION. <br /> <br />The Council of the City of Ramsay ordains: <br /> <br />PROVISIONS OF STATE LAW ADOPTED <br />The provisions of Minnesota Statutes Chapter <br />340A relating to the definition of terms not <br />defined herein, licensing, consumption, sales, <br />financial responsibility of licensees, hours of <br />sale, and all other matters pertaining to the retail <br />sale, distribution, and consumption of intoxicatin9 <br />liquor, are adopted and made a part of this <br />chaplet as if set out in full. <br /> <br />REQUIRED LICENSE <br /> <br />1. ON-SALE LIQUOR LICENSE <br /> No person, except wholesalers or <br /> manufacturers to the extent authorized <br /> under state license, shall directly or <br /> indirectly deal in, sell, or keep for sale any <br /> intoxicating liquor for 'on sale" sale <br /> without first having received a license to do <br /> so as provided in this section. 'On sade' <br /> licenses shall be issued only to: <br /> a) hotels; <br /> b) restaurants; <br /> c) bowling centers; <br /> d) clubs or congressionally chartered <br /> veterans organizations provided that the <br /> organization has been in existence for at <br /> least three years and liquor sales will <br /> only be to members and bona fide guests. <br /> All of the above as defined hereinafter. <br />2. SUNDAY ON-SALE LIQUOR LICENSE <br /> Special on sale licenses for the sale of <br /> intoxicating liquor on Sunday shall be issued <br /> only to hotels, bowlin~c centers, restaurants <br /> and clubs as defined in this chapter. All <br /> sales of liquor by such establishments shal! <br /> be in accordance with M.S.A. 340A.504, <br /> <br />Subd. 3. <br />TEMPORARY ON-SALE LICENSE <br />The City shall not issue temporary on sale <br />licenses. <br /> <br />DEFINITIONS <br />The following terms have the meanings ascribed <br />to them in this section. <br />I. A!ccho!ic beverage. <br /> 'Alcoholic beverage" is any beverage <br /> containing more than one-half of one percent <br /> alcohol by voiume. <br />2. Bowiing cenler. <br /> 'Bowling center' is a business constructed <br /> as and used for the primary purpose of <br /> bowling, and which business establishment <br /> actually contains bowling alleys, pinsetters, <br /> and all other equipment necessary for <br /> bowiing activity and which has a market <br /> value, including land, building, and fixtures, <br /> of at least $200,000 as appraised by the <br /> City Assessor. A business shall not be <br /> considered a 'bowling center" where the <br /> only type of bowling available is through the <br /> use of coin operated amusement devices. <br />3. Club. <br /> "Club' is an incorporated organization <br /> organized under the laws of the state for <br /> civic, fraternal, social, or business <br /> purposes, for intellectual improvement, or <br /> for the promotion of sports, or a <br /> congressionally chartered veterans' <br /> organization, which: <br /> a) has more than fifty (50) members; <br /> b) has owned or rented a building or soace <br /> in a building for more than one (i) year <br /> that is suitable and adequate for the <br /> accommodation of its members; <br /> c) is directed by a board of directors, <br /> executive committee, or other similar <br /> body chosen by the members at a meeting <br /> held for that purpose. No member, <br /> officer, agent, or employee shall receive <br /> any profit from the distribution or sale <br /> of beverages to the members of the club, <br /> or their guests, beyond a reasonable <br /> salary or wages fixed and voted each <br /> year by the governing body. <br />4. City. <br /> "City' is the City of Ramsey, Anoka County, <br /> State of Minnesota. <br /> <br /> <br />
