At the time of each original application for a license, except in the case of an 'on sale' club license, the applicant shall pay in full to the City Administrator an investigating fee as required by Chaplet 130.0110. No investigating fee shall be refunded. Where a new application is filed as a result of incorporation by an existing licensee and the ownership, control and interest in the license are unchanged, no additional license fee will be required. GRANTING OF LICENSES The following procedure shall be followed in processing applications for licenses under this section; 1. All applications for a license shall be referred to the City's Chief of Police and to such other City departments as the City Council shall deem necessary for verification and investigation of the facts set forth in the application. The chief of police shall cause to be made such investigation of the information reouested in ChapTer 130.054 as shall be necessary and shall make a written recommendation and report to the City Council, which shall include' a list of all convictions of violations of federal state or municipal law by the applicant. 2. Upon receipt of the written report and recommendation by the chief of police and at the next regularly scheduled meeting thereafter, the City Council shall instruct the City Administrator to cause to be published in the official newspaper, ten (I0) days in advance, ~ notice of a public hearing to be held by the City Counci!, se',tin~ forth the day, time and place when the hearing will be held, the name of the applicant, the premises where the business is to be conducted, and such other -'~,,,, .... ,=,~+;'"" as the City Council may direct. Within forty-five (45) days after the hearing, the Council may either grant or deny t~e hcense. If the license is granted, the Councii ma), witnnoid its issuance until the aDbJicant has qualified in al! respects for the license. If the premises to be licensed are ncr comp!6te~.~' the time that the hearing is conducted, the Council may grant the. license, but shall withhold ils issuance until the premises have been compieied in accordance with the representations made by the applicant. The Administrator shall, wilhin ten (10) days after the issuance of any license under this section, submit to the liquor control commissioner the full name and address of each person granted a license, the trade name, the effective license date, and the date of expiration of 1he license. He shall also submit to the liquor control commissioner any change of address, transfer, cancellation, or revocation of any license by the Council during the license period. PERSON INELIGIBLE FOR LICENSE No license shall be granted to or held by any person: a) Who is ineligible for such a license by State law; b) Under twenty-one (21) years or age; c) Who is not of good moral character and repute; d) Who is not a citizen of the United States; e) Who, within five (5) years prior to the application for such license, has been convicted of any violation of any law of the United States or the State of Minnesota, or any local ordinance with regard to the manufacture, sale, distribution, or possession for sale or distribution of intoxicating liquor, or non-intoxica, tin~c mal~ liquor or whose license has been revoked for any vioia!,ion of any such iav,'s or ordinances; f) Who is a manufacturer or whoies~ier of
