PROPOSED FINDINGS 0F FACT <br />CONDITIONAL USE PERMIT <br />RHONDA WILLIAMS AND PHILIP S~IGGUM <br /> 17450 BAUGH STREET N.W. <br /> <br />1) <br /> <br />2) <br /> <br />That Rhonda Williams and Philip Swiggum, hereinafter referred to as <br />"Applicants", have properly applied for a conditional use permit to <br />maintain a hobby horse farm to accommodate a maximum of five (5) horses <br />at any one time. <br /> <br />That the Applicants appeared before the Planning and Zoning Commission <br />for a public hearing pursuant to Section 170.013D of the City Code on <br />on December 6, 1988 and that said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby <br />incorporated by reference. <br /> <br />3) That the subject property is generally known as 17450 Baugh Street N.W. <br /> and is legally described as follows: <br /> <br />The east 439 feet of the north 200 feet of the south 1233 feet <br />of the southeast quarter of the southwest quarter of Section 6, <br />Township 32, Range 25 in Anoka County, Minnesota, said distances <br />being measured parallel with the east and south lines of the <br />southwest quarter of said Section 6 (subject to an easement for <br />road purposes over the east 33 feet thereof). <br /> <br />-and- <br /> <br />The north 200 feet of the south 1233 feet of the west 439 feet of <br />the east 878 feet of the southeast quarter of the southwest <br />quarter of Section 6, Township 32, Range 25, in ~noka County, <br />Minnesota, as measured along the south and east lines of said <br />southeast quarter of the southwest quarter. <br /> <br />4) That the two subject parcels are continguous and total approximately <br /> 4.2 acres in size. <br /> <br />5) That the subject property is located in the R-iR Residential District. <br /> <br />6) <br /> <br />That Section 110.07 of the City Code requiring that there be at least <br />three acres for each horse maintained on a parcel has been in effect <br />since 1978. <br /> <br />7) That Section 170.016A of the City Code requiring that all accessory <br /> buildings housing animals be at least 75 feet from neighboring property <br /> lines became effective with recodification in 1986; the b~rn on ~he~ .~ / <br /> subject property was in existence prior to that time. .~/ /~ ~g~A ~ ~.~/ <br /> fl/ <br />8) That the adjoining properties are zoned R-iR Residential and are <br /> occupied by residential structures. <br /> <br />9) <br /> <br />That the Applicants have stated that horses have been maintained on the <br />property since it was developed in 1971. <br /> <br />10) That the Applicants have stated that there are approximately eight <br /> other horse hobby farms in the neighborhood. <br /> <br /> <br />
