b. A minimum of 2,000 square feet either in the basement or on the ground level floor, said space to be usable for storage purposes. The space rquired by both (a) and (b) herein must be devoted exclusively to the use of the off-sale liquor establishment. 6. No off-sale license shall be granted within 1,000 feet of any elementary, secondary, or vocational school or within 1,000 feet of any church. For purposes of this measurement, the distance shall be determined by measuring the distance between the main entrance of the school and church and the main entrance of the licensed business. 7. No off-sale license shall be granted unless the proposed business is located in an area zoned to permit such a land use. CONDITIONS GOVERNING LICENSE ISSUANCE The following conditions govern issuance of a license pursuant to this section: 1. Every license shall be granted subject to the provisions of this section and of any other applicable ordinance or law, including Chapter 340A of Minnesota Statutes. 2. The license shall be posted in a conspicuous place in the licensed premises at all times. 3. Every licensee shall be responsible for the conduct of the licensee's place of business and for the conditions of sobriety and order in the place of business and on the premises. 4. No "off-sale" licensee shall sell alcoholic beverage "on-sale". 5. No license shall be effective beyond the building space shown in the license application for such license. 6. No person under eighteen (18) years of age shall be employed in any rooms constituting the place in which alcoholic beverages are sold at retail. 7. No alcoholic beverage shall be sold or furnished or delivered to any intoxicated person, to any habitual drunkard, to any person under twenty-one (21) years of age or to any person to whom sale is prohibited by state law. 8. No licensee or employees of a licensee shall keep, possess, or operate or permit the or operation of any slot machine, dice, or any gambling device or apparatus on the licensed premises, or in any room adjoining the licensed premises, nor shall any such person permit any gambling therein, except as authorized by the State of Minnesota charitable gambling law. 9. No licensee shall knowingly permit the licensed premises or any room in those premises, or any adjoining building directly or indirectly under the licensee's control, to be used as a resort for prostitutes. 10. Any police officer, health officer, sanitarian, building inspector, or any property designated officer or employee of the City shall have the right to enter, inspect and search lhe premises of the licensee during business hours without a warrant. 1 1. No licensee shall apply for or possess a Federal Wholesale Retail Liquor Dealer's special tax stamp or a federal gambling stamp. 12. No equipment or fixture in any licensed place shall be owned in whole or in part by any manufacturer or distiller of alcoholic beverage, except such as shall be expressly permitted by state law. 13. The retail sale for beverage purposes of ethyl alcohol or neutral spirits, or substitutes therefore, possessing the taste, aroma, and characteristics generally attributed to ethyl alcohol or neutral spirits, as such, is hereby prohibited. Nothing in this paragraph shall be construed to prohibit the sale of other products obtained by the use of ethyl alcohol or neutral spirits as defined in U.S. Treasury Department, Bureau of Internal Revenue, Regulations 125, Article II, Standards of Identity for Distilled Spirits. 14. The business records of the licensee, including federal and state income tax returns, shall be available for inspection by the City Council or other duly authorized representative of
