c) d) e) f) Describe in sufficient detail each violation. Contain an outline of remedial action which, if taken, will effect compliance with the provision of this ordinance. Allow a reasonable time, not to exceed sixty (60) days for the pedormance of any act required. Be served upon the owner, agent, operator or occupant: such notice shall be deemed to be properly served if a copy thereof is: i ) served personally upon said owner, agent, operator or occupant; ii) sent by mail to the last known address of the owner, agent, operator, or occupant; or iii) upon failure to serve the Compliance Order through i) or ii) above, said Order will be posted at a conspicuous place in or about the affected dwelling unit. SECTION 110.198C - PENALTIES: Failure to meel the requirements of the Compliance Order shall be a violation of this ordinance and a misdemeanor and is subject to all penalties as provided by State Statute. Each day the violation continues in existence shall be deemed a separate violalion. SECTION 110.198D - EXECUTION OF COMPLIANCE ORDERS: Upon failure to comply with a Compliance Order within the time set and no appeal having been taken, the City Council may, by resolution, cause the cited deficiency to be remedied as set forth in the Compliance Order. The cost of such remedy shall be levied against the subject property and may be levied and collected as a special assessment in the manner provided by City Charter. SECTION 110.198E - APPEAL: When it is alleged by any person to whom a Compliance Order is directed that such Compliance Order is based upon erroneous interpretation of this ordinance, such person may appeal the Compliance Order as set forth in City Code Section 170.013H entitled "Board of Adjustment". The filing of an appeal shall stay all proceedings, unless such a stay would cause imminent peril to life, health, safety or property. SECTION 110.198F - EMERGENCY CASES: When a violation of this ordinance constitutes an imminent peril to life, health, safety or property, the City may require immediate compliance and if necessary take appropiate action to correct the violation. SECTION 110.198G - SEVERABILITY: Should any portion of this ordinance be found to be violative of any provisions of the Constitution of the State of Minnesota or the United States of America, such a finding will affect only such portion and the remainder of this ordinance shall continue in full force and effect. SECTION 110.198H - EFFECTIVE DATE: This ordinance becomes effective thirty (30) days after publication, subject to City Charter, Section 5.04.
