Councilmember Bawden stated that he disagrees with Item #4 of the proposed <br />resolution which requirea a minimum of 6,000 square feet of merchandise <br />floor space as existing facilities are required by ordinance to have only <br />4,000 square feet. <br /> <br />Councilmember Bawden referred to Item ~'s 1 and 2 of the proposed <br />resolution (requiring location to be urban area and facility to be served <br />by public utilities) and disagreed with proprietary specifications that <br />dictate where a business can be located; appropriate business locations <br />should be determined by zoning and be a decision of the owner. <br /> <br />Brad Dahl - 6015 Radium Circle - Stated that he agrees with Councilmember <br />Bawden's comments and requested that Council not limit the additional off- <br />sale liquor license to the urban area. <br /> <br />Bradley Kern - 17940 Uranium Street - Stated that he feels the intent to <br />assure a certain level of investment in a facility by requiring a minimum <br />of 6,000 square feet is met with the existing 4,000 square foot <br />requirement; that anyone who currently holda a liquor license should not be <br />eligible for another license a~ it leads to monopolizing and loss of <br />competitiveness. <br /> <br />Mr. Dick Muller - Stated that restricting the additional off-sale license <br />to the urban area is unfair to owners of commercial property in the rural <br />district. <br /> <br />Councilmember DeLuca stated that requiring a minimum of 4,000 square feet <br />is reasonable; restricting issuance of the license in the urban area is <br />an extension of Council's policy to encourage development in the urban <br />~rea. <br /> <br />Y~yor Reimann noted that restricting the location of a business may be it's <br />downfall as the urban area may not be a viable location at this time. <br /> <br />Mr. Hartley noted that the recipient of the addtional off-sale liquor <br />license can also be determined by random aelection rather than by <br />establishing criteria. <br /> <br />Councilmember Sorteberg noted that in the past the City has not restricted <br />general business development to the sewer and water area, only high water <br />usage businesses. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Pearson <br />to adopt Resolution f-~88-241, amended as follows, establishing criteria for <br />the issuance of an off-sale liquor license and directing City Staff to <br />prepare an ordinance for same: <br /> <br />a. Eliminate Item ~2 of the criteria requiring the facility to be <br /> served by public sewer and water. <br /> <br />b.
