Off-Sale Liquor License Ordinance Page 7 <br /> <br /> the provisions of Chapter 278, Minnesota Statutes, questioning the amount or validity of <br /> such taxes, the Council may, on application by the licensee, waive strict compliance with <br /> this provision; no waiver may be granted, however, for taxes or any portion thereof which <br /> remain unpaid for a period exceeding one (1) year after becoming due. <br />3. No license shall be granted to a foreign corporation. <br />4. No license shall be granted for any place which has a common entrance or exit between any <br /> two (2) establishments, except that a public concourse or public lobby shall not be <br /> construed as a common entrance or exit. <br />5. No off-sale license shall be granted unless the building proposed to be the licensed premises <br /> contains the follow, lng space requirements: <br /> a. A minimum of'~',000 square feet on the ground level floor for sales-and display, hnd~ <br /> b. A minimum of' 2,000 square feet either in the basement or on the ground level floor, <br /> said space to be usable.~for~oses. The space r~red b~d (b) <br /> herein must be devoted~ly to the u_---~-of the off-sale liquor establishment. <br />6. No off-sale license shall be granted wit"~'~-m 1,000 feet of any elementary, secondary, or' <br /> vocational school or within 1,000 feet of any church. For purposes of this measurement, <br /> the distance shall be determined by measuring the distance between the main entrance of the <br /> school and church and the main entrance of the licensed business. <br />7. No off-sale license shall be granted unless the proposed business is located in an area zoned <br /> to permit such a land use. <br /> <br /> CONDITIONS GOVERNING LICENSE ISSUANCE <br />The following conditions govern issuance of a license pursuant to this section: <br />1. Every license shall be granted subject to the provisions of this section and of any other <br /> applicable ordinance or law, including Chapter 340A of Minnesota Statutes. <br />2. The license shall be posted in a conspicuous place in the licensed premises at all times. <br />3. Every licensee shall be responsible for the conduct of the licensee's place of business and <br /> for the conditions of sobriety and order in the place of business and on the premises. <br />4. No "off-sale" licensee shall sell alcoholic beverage "on-sale". <br />5. No license shall be effective beyond the building space shown in the license application for <br /> such license. <br />6. No person under eighteen (18) years of age shall be employed in any rooms constituting <br /> the place in which alcoholic beverages are sold at retail. <br />7. No alcoholic beverage shall be sold or furnished or delivered to any intoxicated person, to <br /> any habitual drunkard, to any person under twenty-one (21) years of age or to any person <br /> to whom sale is prohibited by state law. <br />8. No licensee or employees of a licensee shall keep, possess, or operate or permit the or <br /> operation of any slot machine, dice, or any gambling device or apparatus on the licensed <br /> premises, or in any room adjoining the licensed premises, nor shall any such person <br /> permit any gambling therein, except as authorized by the State of Minnesota charitable <br /> gambling law. <br />9. No licensee shall knowingly permit the licensed premises or any room in those premises, or <br /> any adjoining building directly or indirectly under the licensee's control, to be used as a <br /> resort for prostitutes. <br />10. Any police officer, health officer, sanitarian, building inspector, or any property <br /> designated officer or employee of the City shall have the right to enter, inspect and search <br /> the premises of the licensee during business hours without a warrant. <br /> <br /> <br />
