City Councilmen <br />April 6, 1989 <br />Page Three <br /> <br />"In order to meet the community-.needs for'~park <br /> and open space, 15 acres of park shall be required <br /> for each 1,000 residents, of which 10 acres <br /> shall be designated as neighborhood parks". <br /> <br />These cer%ainly are minimum requirements but the open space <br />contribution in the Northfork PUD is almost 400 times the <br />minimum. <br /> <br /> On the basis of the foregoing North Fork believes that it <br />has met all reasonable requirements for park dedication and that <br />any further cash requirements would be unwarranted and challengeable <br />as unfair under applicable Minnesota case law particularly <br />Collis vs. City of Bloomington, 246 NW2d 19. <br /> <br /> We would hope that these matters could be amicably resolved <br />and look forward to discussing them more fully with you in the future. <br /> <br />S~ncerely, <br /> <br />~ennis F.
