Commissioner Bauer introduced the following resolution and moved for its adoption: <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME. <br />WHEREAS, Sharp & Associates, LLC, a limited liability company under the laws of the <br />State of Minnesota (the "Permittee ") has properly applied for a variance from the front yard <br />setback requirements in the E -2 Employment District on the property generally known as 6815 <br />McKinley Street NW and legally described as: <br />Lot 1, Block 1, Ebony Addition, Anoka County, Minnesota <br />and <br />RESOLUTION #13 - 06 - 101 <br />Lot 1A, Block 1, Ebony Addition, Anoka County, Minnesota. <br />(the "Subject Property "); and <br />WHEREAS, the Planning Commission met on June 6, 2013, conducted the public hearing <br />and adopted findings of fact relating to the request for a variance from the front yard setback on <br />the south side of the site. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF <br />THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br />1. Based on Findings of Fact #0913, a variance to the front yard setback requirement is hereby <br />granted for the proposed building expansion. <br />2. The proposed addition on the Subject Property shall maintain a minimum setback of <br />twenty -two (22) feet at its closest point, at the southwest corner of the building addition, to <br />the front property line (south lot line). <br />3. The Permittee shall construct <br />4. The Permittee shall obtain all necessary permits prior to commencing any construction. <br />No building permit shall be issued until the Permittee has signed the variance and <br />reimbursed the City for all costs incurred in processing the application. <br />5. The Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br />
