Councilmember Tossey introduced the following resolution and moved for its adoption: <br />RESOLUTION #13 -06 -088 <br />111111 11111 11111 111 ID 211 1111111111 I 9 12 I I I 1 1111 1111 2 <br />R <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT #0912 AND DECLARING TERMS OF PERMIT TO <br />MAINTAIN TWO HORSES ON PROPERTY THAT CONTAINS 2.5 -ACRES OF LAND. <br />WHEREAS, the Ramsey City Council adopted Resolution #13 -06 -087 adopting <br />Findings of Fact #0912 to maintain two (2) horses on property that contains 2.5 -acres of land and <br />herein approves the Conditional Use Permit subject to the following conditions. <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />On June 25, 2013, a Conditional Use Permit ( "Permit ") was issued by the City of Ramsey <br />( "CITY ") to Linda Eidem ( "PERMITTEE ") to maintain two (2) horses on 2.50 acres on the <br />property generally known as 8010 176 Ln NW and legally described as follows: <br />Lot 6, Block 4, DEERWOOD, subject to easement of record, Anoka County, <br />Minnesota <br />( "Subject Property"). <br />2066286.003 <br />This Permit is issued pursuant to Section 10 -24 of the Ramsey City Code. The conditions of this <br />Permit are as follows: <br />1. This Permit shall remain in effect so long as the terms contained herein are complied with. <br />2. This Permit shall allow for the maintenance of a maximum of two (2) horses on the Subject <br />Property. <br />3. That the PERMITTEE agrees to abide by all provisions of City Code Chapter 10 (Animals) <br />and City Code Section 10 -24 (Horses) including rodent /insect control, care /maintenance of <br />horses, as well as control, trespass, roadways and impoundment. <br />4. Upon confirmation of complaints regarding the nuisance of horses the City may take action <br />to abate the nuisance in accordance with City Code Chapter 30 (Nuisances). <br />5. That upon any conviction of an animal nuisance pursuant to Item #3 herein, the City may <br />also take action to revoke this Permit pursuant to its conditional use permit revocation <br />procedures. <br />
