CASE # <br /> <br /> REQUEST FOR AN INTERIM USE PERMIT TO <br />ALLOW FOR OUTDOOR STORAGE IN THE E-2 EMPLOYMENT DISTRICT; <br />CASE OF BRUCE VOLK <br /> By: Megan Wald, Associate Planner <br /> <br />Background: <br /> <br />Bruce Volk orB & A Cylinder has submitted an application for an Interim Use Permit to allow for <br />outdoor storage of Recreational Vehicles (RV) as a secondary pr/nc/pal use on the property located <br />at 14165 Ramsey Blvd. <br /> <br />The following items are enclosed for your, review: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Site plan <br />Draft Planning Commission meeting minutes dated November 6, 2003 <br />Proposed Resolution for Findings of Fact <br />Proposed Resolution to approve Interim Use Permit <br /> <br />Notification: <br /> <br />State law requires notification to properties within 350 feet of the boundaries of the subject property <br />and property owners within that radius were notified. <br /> <br />Observations: <br /> <br />Mr. Volk's property is approximately 4.5 acres in size and is zoned E-2 Employment. Mr. Volk is <br />operating a manufactuhng facility as the principal use on the subject property. The applicant is also <br />storing RV's on the property, which is considered a secondary principal use operating on the <br />property. City Code states that there shall be one principal use operating on a property. <br /> <br />On March 24, 2003, the City sent Mr. Volk a letter notifying him that storing RV's on his property <br />was in violation of City Code and he needed to remove the items from his property or discuss other <br />options with the City. Mr. 'Volk would like to continue to store RV's for RV World and therefore <br />submitted an application requesting an interim use permit to store recreational vehicles as a principal <br />secondary use on his property from December 1 to August 1 of every year. <br /> <br />The Planning Cormrtission held a public hearing and reviewed the request at their November 6, 2003 <br />meeting. During the public hearing, the applicant's stated their objection to installing a Class 5 <br />surface where the RV's will be stored. They are concerned with making the investment of installing <br />a Class 5 surface if the permit is to expire in two years. The applicant's stated they would be willing <br />to provide lawn maintenance on a weekly basis in lieu of installing a Class 5 surface. <br /> <br />Recommendation: <br /> <br />It is both staff and the Planning Commission's opimon that since the subject property is located <br />adjacent to the Town Center, allowing for the proposed temporary use seems appropriate during the <br />first few years of Town Center construction. <br /> <br />The Planning Commission recommended that the City Council approve the Interim Use Permit to <br />allow B&A Cylinder to store RV's and travel trailers as a secondai-y principal use on the subject <br />property until August 1,2005.
