Recommendations: Both staff and the Planning and Zoning Commission concur with the Anoka County Department of Transportation in minimizing the number of driveways from County Roads. In response to this mutual concern to limit d~veways, staff recommends that Council direct staff to proceed with the negotiated purchase of necessary lands for the extension 180th Avenue Northwest to allow for the highest and best use of Lot 4, Block i of the proposed Gordon's Gardens 2nd Addition. Furthermore, staff recommends that the subdivider incur all costs associated in the negotiated purchase. If' the negotiated purchase proves to be unsuccessful, that the City Council direct staff to proceed with emminent domain pending concurrence of financial responsibility for the condemnation by the subdivider. Council Action: Motion to direct/not direct City Staff to proceed with the negotiated purchase of necessary lands for the extension of 180th Avenue Northwest and to proceed in the event of successful purchase, the vacation of portions of the cul-de-sac, which would become unnecessary in the event of the extension of 180th Avenue Northwest. Furthermore, the subdivider would assume financial responsibility for the negotiated purchase and would also be financially responsible for the restoration of the cul-de-sac prior to vacation to those benefitting property owners residing outside of the proposed subdivision as part of the Development Agreement for Gordon's Gardens 2nd Addition. Motion to direct/not direct City Staff to proceed with emminent domain of necessary lands for the extension of 180th Avenue Northwest, pending the financial commitment of the subdivider to incur those costs, if negotiated purchase proves unsuccessful.
