CASE <br /> <br />ADOPT AN ORDINANCE REG~TING TI-IE DUMPING OF GARBAGE, <br />REFUSE, SITE DEVE! X)PMENT AND CONSTRUCTION DEBRIS <br /> By: Glyn H. Huff, B~]ilding Official <br /> <br />Backgro,~nd: <br /> <br />Construction sites are for the most part relatively clear of debris within the City of <br />Ramsey. However, there have been construction sites that have not had the <br />commitment of the builders to keep their "work" areas clean and free of debris. <br />In some cases, contractors dig holes to bury debris. This practice of "casual <br />dumping" may interfere with future development of the lot and also may cause <br />harm to the surface water. Refer to Ramsey City Code 110.18 and 110.182: <br /> <br />11C.18 DUMPING OF GARBAGE AND REFUSE <br /> <br />110.181 ACTS FORBIDDEN <br /> <br />No person, corporation, partnership, joint venture, association or other <br />form of business association shall leave, place, throw or deposit, or cause or <br />permit any other person to leave, place, throw or deposit in or upon any <br />street or public place, or in or upon any vacant or private lot or premises, <br />any ashes, rubbish, garbage, refuse or other like or similar substance or <br />materials. <br /> <br />110.182 ACTS PERMITTED <br /> <br />The owner, or one acting with the owner's written permission, of any <br />private property may fill in or deposit upon property owned by him, ashes or <br />other substances which are free from dead animals or vegetable matter and <br />other unwholesome or putrid substances or materials, if such person has <br />first secured in writing the permission of the City Clerk to do so. The City <br />Clerk shall freely grant such permission, except where it appears by all <br />evidence that such acts will be a nuisance or in some manner be a threat to <br />the health or safety of the City. The City Council in all cases may direct the <br />City Clerk to grant such permission. <br /> <br />This may be inadequate, considering what staff would like to address. In addition <br />to the above background statements, the construction debris containment <br />ordinance should help to prevent construction material (subject to being blown by <br />the wind) being deposited on neighboring properties. For your information, the <br />following item is enclosed: <br /> <br />A. An ordinance regulating the dumping of garbage, refuse, site <br /> development and construction debris. <br /> <br /> <br />
