Case # 13 EASEMENT ACQUISITION 153RD AVENUE N.W./BURLINGTON NORTHEP. N R~ILROAD CROSSING By: William K. Goodrich, City Attorney BACKGROUND: As the Council is aware, the City is in the process of acquiring easements in order to construct the above referenced street and railroad crossing. We have made an offer of 55¢ per square foot for two parcels owned by Mr. and Mrs. Carroll D. Welte. This offer is based upon our appraiser's appraised value. The size of Parcel 1 is 18,127 square feet and the size of Parcel iA is 22,210 square feet. Parcel lA is not actually needed for the project, however, because the taking of Parcel 1 actually severs Parcel IA from the rest of the landowners' property, it was felt we would need to acquire this parcel too. We then will attempt to trade this parcel for Parcel B, which we are acquiring from the adjacent property. Mr. and Mrs. Welte have countered our offer with a request for 260 feet of chain link fencing with three (3) barbed wire strands on top, which fence would be placed on the northwest corner of Weltes' property adjacent to our new roadway. The Weltes also would like an entrance gate at their access onto the new roadway. In addition, they are requesting that we place survey markers at the northwesterly and northeasterly corners of their lot after our construction has been completed. The cost of the fencing is $6.75 per lineal foot and the gate is $990.00. The total acquisition cost w0u]d then be: Parcel 1 $ 9,969.85 Parcel iA 12,215.50 Fence 1,755.00 Gate 990.00 Total: $24,930.35 Finally, the Weltes want to be assured that there will be no special assessment levied as a result of this project.
