10. 11. 12. 13. 110.076 1. The City Clerk shall turn over the proceeds of any sale to the City Treasurer. On order of the City Council, the City Treasurer shall pay to the owner of such horse the difference between the sale price, after deducting the cost of impounding, feeding and sales charges, if the owner makes claim for the monies within one (1) year from the date of sale; otherwise, it shall be forfeited to the City. No person may ride or drive a horse after sunset and before sunrise along or crossing any public way without, appropriate lighting or reflectorized clothing. No person may ride or drive a horse in any public park, beach, golf course or other public property except within the right-of-way of public streets and highways and in areas duly designated as a trail or hitching area. The City Council shall designate and properly post those areas in public lands and parks where horses may be ridden. Every person riding a horse or driving any horse-drawn vehicle upon a public roadway shall be subject to those provisions of the City Code applicable to the driver of a motor vehicle, except those provisions which by their nature have no application. No horse shall be ridden or driven in any manner which would cause undue damage to any hard-surfaced road. No person shall ride or drive any horse upon private property without the prior written permission of the owner or occupant thereof. No person shall interfere with any horse ridden or kept in a lawful manner, and owners of domestic animals shall restrain their animal so as to not interfere. SITE PLAN The applicant will provide a detail dra~-~ng of the proposed use showing existing and proposed structures, significant topographic information, proposed pasture area and any other pertinent information requested by the horse committee. The proposed use will be evaluated by the horse committee. Size and suitability of the land, surrounding land uses, existing similar uses and existing neighborhood character will be considered. The horse committee will develop findings of fact and recommend approval or denial of the request by the City Council. If the horse committee recommends approval of the request, conditions of the request, if any, will be included.
