<br />Councilmember LeTourneau introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #13-08-144 <br /> <br />RESOLUTION APPROVING THE CONVEYANCE OF A PEDESTRIAN AND BICYCLE <br />TRAIL EASEMENT FROM CAPSTONE HOMES INC. ON LOT 1, BLOCK 2 <br />SWEETBAY RIDGE. <br /> <br /> WHEREAS, <br />on June 28, 2013, Capstone Homes, Inc., submitted a Building Permit <br />application to the City of Ramsey for a single family home to be constructed on Lot 1, Block 2 <br />Sweetbay Ridge; and <br /> <br />WHEREAS, <br /> through the review of the Certificate of Survey submitted with the Building <br />Permit application, a trail encroachment across a portion of the rear yard was identified without a <br />properly recorded easement; and <br /> <br />WHEREAS <br /> , Capstone Homes, Inc., the owner of Lot 1, Block 2 Sweetbay Ridge, has <br />agreed to convey to the City of Ramsey a Pedestrian and Bicycle Trail Easement to rectify this <br />encroachment. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> <br />1)That the Ramsey City Council hereby approves the conveyance of a Pedestrian and Bicycle <br />Trail Easement from Capstone Homes, Inc., over a portion of Lot 1, Block 2 Sweetbay <br />Ridge. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Riley, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Strommen <br /> Councilmember LeTourneau <br /> Councilmember Riley <br /> Councilmember Johns <br /> Councilmember Kuzma <br /> Councilmember Tossey <br /> <br />and the following voted against the same: <br /> <br /> None <br /> <br />and the following abstained: <br /> <br /> None <br /> <br /> <br />
