CC Regular Session <br />Meeting Date: 08/27/2013 <br />By: Chris Anderson, Community <br />Development <br />Information <br />Title: <br />Approve Revised Site Plan and Development Permit for McDonald's <br />4. 7. <br />Background: <br />On August 16, 2013, the City received revised plans for the McDonald's project. The plans reflect a slightly <br />reduced building footprint, shortening the length of the building by a total of ten (10) feet (five [5] feet on the north <br />end and five [5] feet on the south end). While this is a minor revision overall, it does represent a change from the <br />approved Site Plan (approved by City Council on January 22, 2013). Also, the Development Permit had indicated <br />a completion date of January 22, 2014 for all required improvements. However, the applicant has yet to close on <br />the purchase of the property from the Housing and Redevelopment Authority (HRA). Within the Real Estate <br />Agreement (REA) with the HRA, the required improvements are to be completed within 720 days of closing on the <br />property. Therefore, the Development Permit has also been revised to reflect a required completion to match that in <br />the REA (720 days from the date of closing on the property). The Attorney has advised that the two documents <br />should be consistent, as the REA date would prevail. Typical store construction would take 180 days. <br />Notification: <br />Observations: <br />The reduced building footprint does result in a slight reduction in seating; however, the number of parking stalls <br />provided still complies with the standards of the Design Framework. Reducing the building footprint will result in <br />slightly more pervious area (additional sod) on site. There do not appear to be any other significant changes from <br />the originally approved Site Plan. <br />McDonald's policies are such that they require that the City issue the Building Permit before they will complete the <br />real estate transaction with the City's HRA. A component of allowing Staff to issue the Building Permit is the <br />executing of the Development Permit. The proposed revisions to the Site Plan and Development Permit are fairly <br />minor and, at least with the Development Permit, will mirror certain dates within the REA and thus, it seems <br />reasonable to approve both. <br />Recommendation: <br />Staff recommends approving both the revised Site Plan and Development Permit. <br />Funding Source: <br />All costs associated with this request are the responsibility of the Applicant. <br />Council Action: <br />Motion to approve the revised Site Plan and Development Permit. <br />Attachments <br />Site Location Map <br />Revised Site Plan <br />Revised Development Permit <br />Revised Exhibit A (in Development Permit) <br />
