Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #13-09-151 RESOLUTION REAFFIRMING COUNCIL ACTION OF APPROVING FIRST AMENDMENT TO AMENDED AND RESTATED PARKING USE AND MAINTENANCE AGREEMENT — RAMP A WHEREAS, in April 2012, the City Council, the Housing and Redevelopment Authority and the Economic Development Authority, approved the Amended and Restated Parking Use Maintenance Agreement (PUMA) — Ramp A; and WHEREAS, the amended agreement addressed issues such as the concept of the dedication of spaces to The Residence at THE COR, and related signage and use issues surrounding the ongoing operation of the parking ramp; and WHEREAS, the Agreement, recorded in May 2012, included a provision for the preparation and execution of an amendment to the agreement; and WHEREAS, on January 8, 2013, the City Council unanimously approved the First Amendment to the Amended and Restated PUMA for Ramp A; and WHEREAS, the City Council must approve this amendment to the PUMA via adoption of a resolution in order for the agreement to be recordable, therefore, this resolution is affirmation of the action taken by the Ramsey City Council on January 8, 2013. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City of Ramsey hereby affirms by this resolution, the approval of a First Amendment to the Amended and Restated Parking Use and Maintenance Agreement — Ramp A — original action took place on January 8, 2013. 2) That the City Council directs staff to execute the resolution and forward a certified copy for recording.
