An tndividual Sewage TreatmentSystem which poses an imminent threat to pubtic health and <br />safety shall be brought into comp!iance with this ordinance in accordance with a schedule <br />estabtished by the Department, which schedule wiU not exceed forty-five days unless the <br />Deartment find extenuating circumstances. <br />B. A faiting system, other than onethat p�ses an imminent heatth or safety threat, shallbe brought <br />f2— t(C' <br />into compiiance within w.ent months after receiving notice from the Department. <br />2.08 Non -Complying Systems Existing systems which are non-comptying, but are not an- imminent heatth er <br />safety threat or faiting, may continue in use so long as the use is not changed or expanded. If the use <br />changes or is expanded, the non -complying elements of the existing system must be brought into <br />cQmpliance. <br />2.09 Non-Comptyirig Work. New individual sewage treatment system construction tht is non-compliant, or <br />other work on a system that is non-comptying, must be brought into compIiaicewith this �rditince in <br />crdance vith a'schedule established by the Department, whictYsch�dulewil! rO °d evn d'k <br />iinIes the Department finds extenuating circunistances; <br />2.10 Change In Use A Certificate of Compliance may be voided if, subsequent to the issuance of the <br />certificate, the use of the premises or condition of the system haschanged or been altered. <br />2.11 Existing System Where the term "existing syst,em" is used it shall mean a system constructed prior to <br />January 1, 1 998 in compliance with the then applicable code. <br />2.12 Site Evaluation and System.Design, Construction, tnspection. and Servicing. Si' <br />an installerhas any un -corrected non -complying construction, <br />theDepartment may withhold issuance ofconstruction permits foi that instalterfor new projects until the <br />non-compliance is corrected. <br />2.13 Where conditions prevent the construction, atteration, and/or repair of an individuat sewage treatment <br />system on an existing developed parcel of real property, the Department may reduce property line arid <br />building setbacks and system sizing requiremerits provided said reduction does not endanger or <br />unreasonably infringe on adjacent properti?s and with the concurrence of the affected properties. <br />3.00 STANDARDS ADOPTED <br />3.04 Minnesota Rutes Parts 7080.0010-7080.0020, 7080.0060-7080.0178,7080.0179, and 7080.031 5- <br />0600 retating to individual sewage treatment systems, as in effect on Aprii 10, 2001, are hereby <br />adopted by reference and made a part of this ordinance as if fully set forth herein. <br />3.05 The rules, adopted in Section 3.04 are amended as foltows: <br />A. Wherever the word "Agency" appears, it shalt be deleted and the word "County" inserted. <br />-2- <br />
