Case ~ 15 <br /> <br /> CONSIDER ABANDONING <br /> DRIVEWAY EASEMENT <br />BETWEEN HIGHWAY 10 AND FRONT STREET <br /> <br />By: William K. Goodrich, City Attorney <br /> <br />BACKGROUND: <br /> <br />For some time the City has maintained a driveway easement serving <br />three homes generally located on the Mississippi River behind the <br />Econ Marketing property. The easement lies between Econ Marketing <br />and the J.A.C. Auto property and goes from Highway 10 south to the <br />homes above mentioned. <br /> <br />There is no longer a need for the city to maintain the easement, <br />as the properties served now have access onto Front Street. I have <br />spoken with Neil Pratt who had an easement over this same property, <br />and Mr. Pratt concurs with this position. Econ Marketing is <br />registering title to its property and would like the City to <br />acknowledge that it no longer has an interest in the easement, or <br />at least that portion of the easement which lies on their property. <br /> <br />ENCLOSURES: <br /> <br />Map showing driveway easement property. <br /> <br />RECOMMENDATION: <br /> <br />Staff recommends the City go on record as having no further <br />interest in the driveway easement described. <br /> <br />COUNCIL ACTION: <br /> <br />Motion to formally acknowledge that the City no longer has an <br />interes ,'n that certain driveway located between Highway 10 and <br />Front Street on Lot 2, AUDITOR'S SUBDIVISION 26, Anoka County, <br />Minnesota; that the City no longer maintain said easement. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney X <br />Engineer X <br />Community Develop- <br />ment Director X <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Other <br /> <br /> <br />
