Variances for the street frontage re~uirements are granted to Lots and 10, Block 1 and Lots 1 and 2, Block 2, such that said Lots may have the following street frontages: Lot 1, Block 1: Lot 3, Block 1: Lot '4, Block 1: Lot 8, Block 1: Lot 9, BIock 1: Lot 10, r, lock 1: Lot 1, Block 2: Lot 2, ~lock 2: 112.51 feet 345 feet 145.12 feet 160 feet 160 feet 160 feet 146.21 66 feet. 6. STAGE II IMPROVEMENTS. Pursuant to Section 170.03 of the City Code, the Developer is required to pay for the first sealcoating required on the streets within the Plat. Therefore, the Developer shall pay to the City the sum of $2,500.00 which is the amount the City has determined will be required to complete the sealcoating. Said amount shall be paid to the City upon execution of this agreement and shall be non-refundable to the Developer. 7. COMPLETION OF IMPROVEMENT~. The Developer agrees to complete the Stage I improvements referred to in Paragraph 1 on or before June 30, 1989. Se BUILDINC P~RMITS. The Developer agrees that, in compliance with the City Code, no building permits shall be is-~ued until (1) the financial security described in Paragraph 2 above and the $1,200.00 described in Paragraph 3 above have been deposited with the City and the $2,500.00 required in Paragraph 5 has been paid, and (2) no building permits shall be issued for Lots 1, 2 and 3, Block 3 and Lots 4 and 5, Block 1, until the elevation of said Lots are raised to an elevation specified by the City Engineer, in order that these lots are deemed buildable. ~IN WITNESS ~REREOF, the parties have executed this instrument this /~E~ELOPEK: David G.
