Case # 7 <br /> <br />DISCUSS PARK DEDICATION FEE AMOUNT <br /> FOR HY-10 RAMSEY 4TH ADDITION <br /> <br /> By: Mark S. Banwart, Community Development Director <br /> <br />Background: <br /> <br />On October 11, 1988, the Ramsey City Cour~cil adopted Resolution No. 88-194 grantin.c final <br />plat approval for Hy-10 Ramsey 4th Addition. Pursuant to this Resolution, the Developer is to <br />execute a Development Agreement with the City outlining the conditions for the development of <br />Hy-10 Ramsey 4th Addition. The park dedication portion of the Development Agreement states <br />that the Developer shall satisfy the City's park dedication requirements by making a cash <br />payment to the City in an amount of Ten Percent (10%) of the market value of the land or Nine <br />Thousand Seven Hundred Forty Dollars ($9,740.00). For your information, the following <br />information is offered: <br /> <br />City of Ramsey Resolution No. 88-194 (Resolution Granting Final Plat Approval <br />to Hy-10 Ramsey 4th Addition). <br /> <br />Development Agreement for Hy-10 Ramsey 41h Addition. <br /> <br />C. (June 9, 1989) <br /> <br />Observations: <br /> <br />On November 16, 1989, discusseo park dedication for Hy-10 Ramsey 4th Addition with Art <br />Raudio and Norm Holm. City Attorney Goodrich stated that Mr. Raudio is concerned with the <br />application of the appropriate park dedication ordinance to Hy-10 Ramsey 4th Addition and the <br />value placed on the property for the selected ordinance to apply to. In this instance, the park <br />dedication ordinance adopted in July of 1988 is being applied to Hy-10 Ramsey 4th Addition. <br />The ordinance indicates that park dedication will be Ten Percent (~0%) of lanc value which <br />would amount to Nine Thousand Seven Hundred Forty Dollars ($9,740.00). Mr. Raudio ststed <br />that he felt that the park dedication should be commensurate with Hy-10 Ramsey 3rd Addition, <br />as Hy-10 Ramsey 4th Addition is a further subdivision of one of the lots in Hy-10 Ramsey 3rd <br />Addition. <br /> <br />It was explained that the Hy-10 development platting of outlots was to facilitate customized lot <br />size for future customers, to imply future subdivision and avoid incurring increased taxes that <br />come with platting lots in a certain period of time. ,r; platting Hy-10 Ramsey 3rd Addition, the <br />Developer desired to plat with an outlot, but the Ci:y insisted on full platting. If Hy-10 Ramsey <br />3rd Addition had been approved with an outlot, the future subdivision of the outlot would have <br />been subject to the park dedication ordinance in effect during Hy-10 Ramsey 3rd Addition. <br /> <br /> <br />
