Construction-Operations
Regulatory Functions (SF 89-316/317-12)

DEPARTMENT OF THE ARMY

~'r. IPAL,~f.. Idl~hdE~TA ~101-147~

April 12,' 1989

Mr. Clayton Berg
14101 St. Francis Blvd ~'
Ramsay. Minnesota 55303

SUBJECT:

Potential wetland fill during the development of two areas referred
to as Wildwood Acres (SF 89-317-12) and North Forty, Second Addition
(SF 89-316-12).

Having reviewed a letter from the MNDNR concerning these projects, we
believe that you will need a Department of the Army permit for the activity
referenced above. We are enclosing application materials. The orange booklet
(E?-1145-2-1) gives background about our program and instructions for
preparing the application.

Because we must provide notice of your project to certain other agencies,
and provide them a reasonable opportunity-to commen: on your proposal, our
public interest review for most projects may take at least 60 days. You can
help us to review your application as quickly as possible if you -

Fill out the application completely and specifically. Note the
instructions on pages 10 and ll of the orange booklet.

Send accurate drawings. See ~ne check list on pages 14 and 15 and
the examples on pages 16 and 17 of the booklet. Following these
examples will help ensure that your drawings will be accurate and
usable.

In order for our office to make an accurate determination on the extent
of wetland involvement the following info-~nr, a~ion would be helpful. A
contour map ~howing both the existing conditions and =he proposed
grading at the site. Another valuable too! is the 1/2 section aerial
photograph, from April 1955 (i inch - 200 feet). This aerial is
available from the County.

Because current Federal regulations discourage =he filling of wetlands
it is essential that you describe an5· alternatives to the project as
planned that you have considered. This consideration should include
other potential sites and other methods of accomplishing the desired
result. Federal laws and rules often prevent issuance of permits where
there .are less environmentally-damaging alternatives available. For
instance, if the project involves placing fill in a water or wetland,
there may be alternatives than would accomplish the project purpose but
would not require filling, or would not require as much fill in as
large an area.

If ),our project will include any temporary placement of excavated or fill
