WHEREAS, the Ramsey Plannin¢ and Zonin¢ Commiss¢on met on March 13, 1989, and <br />recommended the Developer to proceed lo the prehminary p~al stage: and <br /> <br />V'~H,-,~EAS, the Ramsey Park and Recreation Commission met on March ~,1989, and <br />recommended that cash be used to satisfy park oedioation requirements: and <br /> <br />WHEREAS, the Ramsey Planning and Zonin2 Commission met on Ma), 2, 1989, and recommended <br />approval of the preliminary plat of Alicia Addition contingent upon compliance to the City; and <br /> <br />WHEREAS, the Ramsey City Council met on May 23, 1989, and approved the preliminary plat <br />for the Northfork 3rd Addition. <br /> <br />NOW THEREFORE, BE IT RESOLVED, thai the City Council of the City of Ramsey, Anoka County, <br />Slate of Minnesota, as follows: That final plat approval Resolution # 89-08-. of <br />Norlhfork3rd Addition is granted contingent upon the following: <br /> <br />MARKETABLE TITLE. The Developer providing proof of marketable lille for the property <br />to the City of Ramsey. <br /> <br />PARK DEDICATION REQU!REMENTS. Park dedicalion shall be satisfied pursuant to the <br />Northfork PUD Addendum lo Park Dedication Agreement (dated May 9, 1989) and <br />Northfork PUD Park Dedication Agreement (dated February 19, 1987). Whereby Outlot <br />D and Outlot E are dedicated to the City for park purposes. <br /> <br />Co <br /> <br />iMPROVEMENTS. The Developer will construct improvements shown on the plans as <br />directed by the City Engineer, in accordance with the City standards and specifications. <br />These improvements include the construction of the street within the plat known as <br />162nd Lane Northwest, 163rd Lane Northwest and Wolverine Street Northwest; <br />including bituminous sudacing and related ditches, grading, backslopes, drainage and <br />seeding. The Developer shall restore all disturbed ares as specified by the City Engineer. <br />The Developer shall also provide erosion control measures during construction. Said <br />improvements shall be completed on or before June 1, 1990 for Phase I, September 1, <br />1990, for Phase II and November 1, 1990, for Phase Ill. the Phase I, II and Il! areas <br />are shown on Exhibit A, attached to s.nd made a part thereof of this Agreement. <br /> <br />FINANCIAL GUARANT=,__~ The Developer shall provide a financial guarantee for the <br />construction of these improvements. This guarantee shall be in the form of cash or City <br />approved Letter of Credit in the amount of Sixteen Thousand Seven Hundred Dollars <br />($16,700) for Phase I, Eighty Three Thousand Dollars ($83,000) for Phase II and <br />Thirty Five Thousand Dollars ($35,000) for Phase III, which amounts to 125% of the <br />Engineer's estimated cos1 for such improvements. In addition to the Letter of Credit, the <br />Developer shall post a maintenance guarantee at the time of the completion of the <br />improvements in the amount of Ten thousand dollars ($10,000.00). This security shall <br />be deposited with the City in the form of a cash escrow or a Letter of Credit in a form 1o <br />be acceptable to the City. This security shall be held by the City for One (1) year from <br />the date of final acceptance of the improvements. <br /> <br />E. Gq&DING AND DRAINAGE PLAN.
