~70 065 <br /> <br />170. 066 <br /> <br />~ANDARDS FOR ACCEPTING DEDICAT!ON OF LAND FOR PUBLIC <br />PARK PURPOSES <br /> <br />Land proposed to be dedicated for public purposes <br />shall meet identified needs of the CiEy. <br /> <br />Prior to dedication for public purpose, the <br />subdivider shall deliver to the City Attorney, an <br />abstract of title or registered property abstract <br />for such dedication. Such title shall vest in the <br />City good and marketable title, free and clear of <br />any mortgages, liens, encumbrances, assessments and <br />taxes. The conveyance documents shall be in such <br />forum acceptable to the City Council. <br /> <br />The re~cfuired dedication shall be ~.ade at time of <br />final plat approval. <br /> <br />The removal of trees, topsoil, storaoe of <br />construction e~cfuipment, burying of construction <br />debris, or stockpiling of surplus soil is strictly <br />forbidden without the written approval of the City <br />Council. <br />Grading and utility plans, which may affect or <br />impact the proposed park dedication, shall be <br />reviewed and approved by the Parks and Recreation <br />Commission prior to dedication, or at such time as <br />is reasonably deter~ined. <br /> <br />To be eligible for park dedication credit, any !and <br />to be dedicated as a requirement cf this Section <br />shall be useable, developable land for use for park <br />and recreation purposes and shall be at a location <br />convenient to the people to be served. <br /> <br />CASH PAY..~EMT <br /> <br />in lieu of land dedication, the City Council may re~uire <br />the subdivider to contribute a cash pas~ent. The value <br />of such pa3~ent~=~.-~-~ be either the greater ~mount <br />established by a specified contribution per dwell!r? unit <br />or = percent cf fair market value cf the <br />commensurate with the - ~ _ <br /> pe. cen~ of land u'~ othe.-~'ise <br />would have been re.on/ired under sections 170.062 and <br />!70.063 of this chapter.
