PAYMENT OF EASEMENT DAMAGES - REGARDING IMPROVEMENT PROJECT 87-19 By: William K. Goodrich, City Attorney BACKGROUND: ?~"=i-3/-~ - Improvement Project 87-19 was for the construction of water and sewer utilities in the general area of County Road 116 and Sunfish Lake-Boulevard. The city acquired a temporary construction easement from Mrs. Elsie Chicoine who lives at 6021 Industry Avenue N.W. At the time of the taking, the City agreed to pay for any damages Mrs. Chicoine might incur as a result of the taking. Mrs. Chicoine advises that she lost four spruce trees at a value of $130.00 each, one oak tree at a value of $30 and seven fence posts at a value of $10.00, for a total loss of $520.00. The City Engineer has reviewed Mrs. Chicoine ' s claim and finds it reasonable. ENCLOSURES: City Resolution passed in 1987 relating to this issue. STAFF RECOMMENDATION: Payment of $520.00 to Elsie D. Chicoine. COUNCIL ACTION: Motion to pay $520.00 to Elsie D. Chicoine pursuant to City. Resolution 87- , which payment is for a complete settlement of all claims, damages and causes of action said Elsie D. .C~ic0in~ has. against t~e. City and/or its contractors relating to the grant of a temporary construction easement over and across the following-described property, to-wit: That part of the Southeast Quarter of the Southwest Quarter of Section 26, Township 32, Range 25, Anoka County, Minnesota, lying south of the north 504.50 feet of said Southeast Quarter of the Southwest Quarter. Said temporary construction easement is lying northerly of the centerline of County Road No. 116 as it is now laid out and traveled and southerly of a line 45.00 feet north of, as measured at a right angle to and parallel with said centerline of County Road-No. 116 as it is now laid out and traveled.
