Goodrich, City Attorney <br /> <br /> BACKGROUITD: <br /> <br />~=~-You will recalI that at your council meeting on August 22, 1989, <br /> £.~a request was made to the council to extend the off-sale liquor. <br /> license boundary to include property outside of the City's Urban <br /> Area, and to specifically include the Hy-10 Ramsey Addition which <br /> lies directly west of the Urban Area boundary. The City <br /> Administrator has determined that it is not reasonably feasible, <br /> nor in the City's best interests, to attempt an amendment of the <br /> Urban Area boundary at this time because of the potential impact <br /> this may have on the City's newly implemented 4 in 40 policy. With <br /> some exceptions, most of the City's commercial and industrial area <br /> is located within the Urban Area. Staff is therefore recommending <br /> that the off-sale liquor ordinance be amended to provide that <br /> licenses be considered in any commercial area of the City. If the <br /> proposed property is not properly zoned, Council would be able to <br /> consider and accept or reject the rezoning request. This would <br /> permit Council review of site locations, as with any other zoning <br /> requests, and of course in all cases, a site plan permit would be <br /> required. For your information, those parcels in the City zoned <br /> either commercial or industrial which lie outside the Urban Area <br /> are located generally as follows: <br /> <br />Rabbit Street and 169th <br />Intersection of Variolite and 173rd <br />Ramsey Boulevard and 149th (Tom Thumb) <br />167th and Hwy 47 <br />West of County 83 and north of Hwy 10 (Hy i0 Addition) <br /> <br />ENCLOSURES: <br /> <br />Proposed Ordinance amending City's' offhsale Liquor--Chapt. er of.the .... <br />City Code as adopted by Ordinance 89-8, and specifically amending <br />SEction 130.0511(8). <br /> <br />STAFF RECOMMENDATION: <br /> <br />Introduce the enclosed Ordinance, ordinance 89-09- <br /> <br />COUNCIL ACTION: <br /> <br />Motion to introduce Ordinance 89-09- which is an Ordinance <br />amending Chapter 130.05, Section 130.0511(8) of the City Code. <br /> <br /> <br />
