DEyELOPMENT CONTRACT - GOBERNATZ ADDITION <br /> <br />IMPROVEMENTS <br /> <br />177th Avenue N.W. Alienment. DEVELOPER shall grant to the CITY a <br />temporary easement over and across that part of the presently n'aveled portion of <br />177th. Avenue N.W. which encroaches up on the the Plat. The DEVELOPER <br />will execute an easement document in favor of the CITY granting said temporary <br />easement using that legal description as prepared by the City Engineer. Said <br />easement shall be granted to the CITY prior to recording of the Final Plat. The <br />temporary easement will be released by the City at such time as the CITY <br />undertakes an improvement project to improve 177th Avenue N.W. and locate it <br />within its proper right-of-way. <br /> <br />Access to Lots. Access to Lot 3 of the Plat will be from Highway #47 by <br />improving or relocating an existing driveway. Access to Lots 1 and 2 will be from <br />177th Avenue N.W. <br /> <br />p~dication of Streets, Drainage and Utility Easements, Street and <br />drainage and utility easements shall be dedicated to the CITY as shown on the <br />Final Plat. <br /> <br />II, <br /> <br />GENERAL: <br /> <br />Park Dedication. Park dedication shall be satisfied by the DEVELOPER <br />paying to the CITY the sum of Five Hundred and 0/100 Dollars ($500.00) for <br />each new lot created for a total park dedication payment of One Thousand and <br />0/100 Dollars ($1,000.00). <br /> <br />Treo Di~;ea$~ Prevention. The DEVELOPER shall prevent the introduction <br />and spread of tree disease into the residue tree populations of the Plat and <br />adjoining properties and reduce the impacts of construction on the residual <br />property of the Plat and adjoining properties. The DEVELOPER in order to <br />accomplish this shall: <br /> <br />Install physical barriers such as snow fence around trees that are to <br />remain (the fencing will be at least ten feet (10') from the remaining <br />trees; <br /> <br />Insure that all equipment operators will have readily available tree <br />wound dressing and will apply immediately to damaged trees if wounding <br />occurs; <br /> <br />Insure that trees will only be skidded against other trees that are to be <br />removed. Trees in the middle twenty feet (20') of road easement will be <br />removed first, with remaining trees to be removed to be skidded toward <br /> <br /> <br />
