CITY OF RAMSEY <br /> <br /> ANOKA COUNTY, MINNESOTA <br /> <br />DEVELOPMENT C:ONTRA(~T - NORTHF(~RK THIRD <br /> <br /> THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, a <br />municipal corporation of the State of Minnesota (the "CITY"), and NORTH FORK, INC, a <br />Minnesota corporation, whose address is 824 Woodgate Drive, Vadnais Heights, Minnesota (the <br />"DEVELOPER"}. <br /> <br /> WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPER is the fee owner of the following described property <br />situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described as <br />follows: <br /> <br /> See attached Exhibit "A"; <br /> <br />the "Subject Property." <br /> <br /> WHEREAS, on September 26, 1989, the CiTY approved the final plat (Resolution #89- <br />09-__) of the Subject Property which plat is known as NORTHFORK THIRD (the "Plat") <br />contingent on certain requirements, including DEVELOPER and CITY entering into this <br />contract; and <br /> <br /> WHEREAS, no expenditures of CITY funds, will be made until the City Code escrow <br />requirements have been fulfilled by DEVELOPER; and <br /> <br /> WHEREAS, City Code Section 170.039@ defines "Stage I" Improvements and "Stage I1" <br />Improvements which definition is used herein when reference is made to "Stage I" and Stage I1" <br />Improvements; and <br /> <br /> WHEREAS, the DEVELOPER desires to construct the Stage I and Stage II <br />improvements, except for those Stage II Improvements constructed by the CITY. <br /> <br /> NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br /> <br />
