CASE # 8 <br />REQUEST FOR CONDITIONAL USE PERMIT ~IO EXPAND <br />RAMSEY AUTO SALES; CASE OF ROBERT & LOUIS WOJCIK <br />By: Planning Assistant Sylvia Frolik <br /> <br />Background: <br /> <br />On Ma3' 2, 1989, the Planning and Zoning Commission conducted a public hearing regarding the <br />Wojcik request to expand Ramsey Auto Sale and the case was tabled pending submission of a site <br />plan addressing the entire site as proposed. <br /> <br />On Jul>' 18, 1989, the Planning and Zoning Commission reviewed the site plan and tabled action <br />for further information. <br /> <br />The Planning and Zoning Commission met on August I to review the request and expressed a <br />great deal of concern with the history of violations of the existing conditional use permit, the past <br />tendency of this operation to accumulate inoperable vehicles and already serious traffic conditions <br />in the area which are aggravated by the public parking in road right-of-ways to look at auto <br />inventoo' during off-business hours. The Planning and Zoning Commission recommended denial <br />of Robert and Louis Wojcik's request for a conditional use permit to expand Ramsey Auto Sales. <br /> <br />The Citv Council met on August 8 and reviewed the Wojcik's request to expand Ramsey Auto <br />Sales. Gity Staff did note that the proposed expansion is a minor change to an already approved <br />use and the site plan submitted includes development plans that will be an improvement to the site <br />and address some of the existing problems. Two specific areas of discussion between Council, <br />Staff and Robert Wojcik were the desire to maintain the marketability of the property by <br />maintaining two accesses onto Hwy. #10 and not consolidating all 3 lots into one parcel. Council <br />indicated that they will consider approving the request to expand Ramsey Auto Sales and requested <br />that the Planning and Zoning Commission provide input to the terms that will be included in the <br />conditional use permit. <br /> <br />The Planning and Zoning Commission met on September 5 and drafted a proposed conditional use <br />permit for Council consideration.The proposed permit addresses the concerns of the Planning and <br />Zoning Commission with the operation and takes into consideration the City Council's discussion <br />with Robert Wojcik on August 8 regarding accesses and parcel consolidation. <br /> <br />Observations: <br /> <br />The site plan indicates that the 3 parcels involved will accommodate a total of 126 display vehicles <br />and l z~ customer/employee parking spaces. The site plan indicates improvements that will <br />eliminate the bituminous encroachment onto the Cty. Rd. #56 fight-of-way. The site plan also <br />indicates removal of the easterly access onto Hwy. #t0; this is in accordance with the current <br />conditional use permit. <br /> <br />The proposed permit addresses the concerns of the Planning and Zoning Commission with respect <br />to providing off-street parking during off business hours and accumulation of inoperable vehicles. <br />With respect to the applicant's concern for maintaining the marketability of the property, the permit <br />proposes to consolidate the three lots into two and retain two accesses onto Hwy. #10, of which <br />only the westernmost will be allowed for use while the property is utilized for vehicle sales. <br /> <br /> <br />
