S~ics. Tilt Commission proceeded to review Ms. Prolik's memo dated July 26, ]989 which indicated thai the applicants are in violation of their existing conditional use permit. The Commission then reviewed thc correcmd site plan which now indicates location of existin~ septic system, alternate septic system location ant number of employees at the site. Commissioner Hendriksen stated that in addition to the current status of conditional use penni~ compliance, he intended for the histo.'-y of vio!ations at the site to be reported so thru they could be addressed in th(: findings of fact relating to thr request for an expansion. Mr. Banv,'an noted tha~ the applicants have received approval from Mn/DOT for two accesses onto Hwy. #10; CiLv Staff is recommending one access m Hwy. #10 from the westerh' boundary of the property. Commissioner Hendriksen noted that the vehicle sales lot attracts public during off- business hours; the accesses to the business are blocked and people park in the Count>' and State road right-of-way. ix'Lt. Banv,'an noted that parking along State and Count)' right-of-ways is a major problem in the entire Hwy. #10 Corridor and suggested that the Cit.',' intiate a request at the Count>' and State levels to post 'no parking' signs. ix'h-. Banwart also noted that City Staff is recommending that the 3 parcels involved be consolidated into one tax parcel. The Commission proceeded to review the proposed findings of fact. Motion by Commissioner Deemer and seconded by Chairman Zimmerman to amend Item #14 of the proposed £mdings of fact to indicate that the applicant is proposing m'o accesses onto Hwy. #10 if the expansion is approved. Morion carried. Voting Yes: Chairman, Zimmerman, Commissioners Hen.'iriksen, Deemer and Bawden. Voting No: None. Absen.:: Commissioners Shumv,'ay, LaDue and Ten-)'. Motion bv Commissioner Deemer and seconded by Commissioner Bawden to amend Item #17 of the proposed findings of fact to indicate that the applicant is proposing to in,ease the total amount of vehicle displ%'/customer parking spaces from 57 to 140. Motion carried. Voting Yes: Chairman Zimme,wnan, Commissioners Hendriksen, Deemer and Bawden. Voting No: None. Absent: Commissioners Shumway, La.Due and Terry. Motion by Commissioner Bawden and seconded by Commissioner Deemer to amend Item #21 of the proposed findings of fact to ina, dicate that the proposed expansion will not be unduly dangerous to persons residing or v,,of}fng in the vicinitv. Further Discussion: Commissioner Deemer stated fnat the business will be dangerous to the public unless off-street parking is provided during off-business hours.
