S~ics. <br /> <br />Tilt Commission proceeded to review Ms. Prolik's memo dated July 26, ]989 which <br />indicated thai the applicants are in violation of their existing conditional use permit. The <br />Commission note0 thru according to Mr. Gcgxirich's memo of July 26. ]0t.19, th:' Cra' does <br />not have thc authoriD' ~o require f~nancia~ s~u,ntv to be utilized f~r conditiona] use permit <br />enforcement activities. The Commission then reviewed thc correcmd site plan which now <br />indicates location of existin~ septic system, alternate septic system location ant number of <br />employees at the site. <br /> <br />Commissioner Hendriksen stated that in addition to the current status of conditional use <br />penni~ compliance, he intended for the histo.'-y of vio!ations at the site to be reported so thru <br />they could be addressed in th(: findings of fact relating to thr request for an expansion. <br /> <br />Mr. Banv,'an noted tha~ the applicants have received approval from Mn/DOT for two <br />accesses onto Hwy. #10; CiLv Staff is recommending one access m Hwy. #10 from the <br />westerh' boundary of the property. <br /> <br />Commissioner Hendriksen noted that the vehicle sales lot attracts public during off- <br />business hours; the accesses to the business are blocked and people park in the Count>' and <br />State road right-of-way. <br /> <br />ix'Lt. Banv,'an noted that parking along State and Count)' right-of-ways is a major problem <br />in the entire Hwy. #10 Corridor and suggested that the Cit.',' intiate a request at the Count>' <br />and State levels to post 'no parking' signs. <br /> <br />ix'h-. Banwart also noted that City Staff is recommending that the 3 parcels involved be <br />consolidated into one tax parcel. <br /> <br />The Commission proceeded to review the proposed findings of fact. <br /> <br />Motion by Commissioner Deemer and seconded by Chairman Zimmerman to amend Item <br />#14 of the proposed £mdings of fact to indicate that the applicant is proposing m'o accesses <br />onto Hwy. #10 if the expansion is approved. <br /> <br />Morion carried. Voting Yes: Chairman, Zimmerman, Commissioners Hen.'iriksen, Deemer <br />and Bawden. Voting No: None. Absen.:: Commissioners Shumv,'ay, LaDue and Ten-)'. <br /> <br />Motion bv Commissioner Deemer and seconded by Commissioner Bawden to amend Item <br />#17 of the proposed findings of fact to indicate that the applicant is proposing to in,ease <br />the total amount of vehicle displ%'/customer parking spaces from 57 to 140. <br /> <br />Motion carried. Voting Yes: Chairman Zimme,wnan, Commissioners Hendriksen, Deemer <br />and Bawden. Voting No: None. Absent: Commissioners Shumway, La.Due and Terry. <br /> <br />Motion by Commissioner Bawden and seconded by Commissioner Deemer to amend Item <br />#21 of the proposed findings of fact to ina, dicate that the proposed expansion will not be <br />unduly dangerous to persons residing or v,,of}fng in the vicinitv. <br /> <br />Further Discussion: Commissioner Deemer stated fnat the business will be dangerous to <br />the public unless off-street parking is provided during off-business hours.
