DEVELOPMENT AGREEMENT- (;:RO(~KED OAK ADDITION NOW, THEREFORE, the CITY and DEVELOPER agree as ~ollows: I. IMPROVEMENTS 1. Ac~es~ to Lots. Access to both lots of the Plat may be directly onlo Counly Slate Aid Highway #5. Said access onto County State Aid Highway #5 shall be limited to one driveway per lot. 2. Dedication of Drainage end Utility Easement~. Drainage and utilily easements shall be dedicaled to the CITY as shown on the Final Plat. o II, GENERAL: Park Dedication. Park dedication shall be salisfied by the DEVELOPER paying to the CITY the sum of Five Hundred and 0/100 Dollars ($500.00) which represents paymenl for the newly created lot. Variance. The CITY grants a variance to the lot area of each Icl in the plat such that may have minimum lot area of 2.3 acres, which is a variance to the CITY's minimum lot size of 2.5 acres. Tree Disease Prevention. The DEVELOPER shall prevent the introduction and spread of tree disease into the residue tree populations of the Plat and adjoining properties and reduce the impacts of construction on the residual property of the Plat and adjoining properties. The DEVELOPER in order to accomplish this shall: Install physical barriers (e.g. snow fence, string with ribbon, etc.) around trees that are to remain (the barrier will be at least ten feet (10') from the remaining trees; Insure that all equipment operators will have readily available tree wound dressing and will apply immediately to damaged trees if wounding occurs; o Insure that trees will only be skidded against other trees that are to be removed. Trees in the middle twenty feet (20') of road easement will be removed first, with remaining trees to be skidded toward the middle of the road easement. On Site Sewaqe System, In order to meet CITY code requirements for suitable soils for installation o! an on-site sewage system on Lot 1 Block 1, the "drop box distribution" system will need to be utilized.
