DEVELOPMENT AGREEMENT- (;:RO(~KED OAK ADDITION <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as ~ollows: <br /> <br /> I. <br /> <br /> IMPROVEMENTS <br /> <br />1. Ac~es~ to Lots. Access to both lots of the Plat may be directly onlo Counly <br /> Slate Aid Highway #5. Said access onto County State Aid Highway #5 shall be <br /> limited to one driveway per lot. <br /> <br />2. Dedication of Drainage end Utility Easement~. Drainage and utilily <br /> easements shall be dedicaled to the CITY as shown on the Final Plat. <br /> <br />o <br /> <br />II, <br /> <br />GENERAL: <br /> <br />Park Dedication. Park dedication shall be salisfied by the DEVELOPER <br />paying to the CITY the sum of Five Hundred and 0/100 Dollars ($500.00) <br />which represents paymenl for the newly created lot. <br /> <br />Variance. The CITY grants a variance to the lot area of each Icl in the plat such <br />that may have minimum lot area of 2.3 acres, which is a variance to the CITY's <br />minimum lot size of 2.5 acres. <br /> <br />Tree Disease Prevention. The DEVELOPER shall prevent the introduction <br />and spread of tree disease into the residue tree populations of the Plat and <br />adjoining properties and reduce the impacts of construction on the residual <br />property of the Plat and adjoining properties. The DEVELOPER in order to <br />accomplish this shall: <br /> <br />Install physical barriers (e.g. snow fence, string with ribbon, etc.) <br />around trees that are to remain (the barrier will be at least ten feet <br />(10') from the remaining trees; <br /> <br />Insure that all equipment operators will have readily available tree <br />wound dressing and will apply immediately to damaged trees if wounding <br />occurs; <br /> <br />o <br /> <br />Insure that trees will only be skidded against other trees that are to be <br />removed. Trees in the middle twenty feet (20') of road easement will be <br />removed first, with remaining trees to be skidded toward the middle of the <br />road easement. <br /> <br />On Site Sewaqe System, In order to meet CITY code requirements for <br />suitable soils for installation o! an on-site sewage system on Lot 1 Block 1, the <br />"drop box distribution" system will need to be utilized. <br /> <br /> <br />
