DEVELOPMENT AGREEMENT - GORDON'S GARDENS 2ND ADDITION <br /> <br />IMPROVEMENTS <br /> <br />Access to Lot~. One access to Lot 3 from County Road #83 and one access each <br />for Lots 1 and 2 on County State Aid Highway #22 will be permitted. The <br />driveways for Lots 1 and 2 shall be along the common lot line and an area 30 feet <br />in widlh on each side of the common lot line shall be designated for the driveway <br />locations. The remainder of the frontage shall have the right of access dedicated <br />to Anoka County. This will require that the driveways access only at the specified <br />location and no additional driveways will be allowed. The right of access from <br />Lot 3 to County State Aid Highway #22 shall also be dedicated to Anoka County. <br /> <br />Dedication of Drainaoe and Utility Easements. Drainage and utility <br />easements shall be dedicated to the CITY as shown on the Final Plat. <br /> <br />Street Easement. Upon recording of the final plat, DEVELOPER shall convey <br />by deed to Anoka County, an easement for street and utility purposes over, under <br />and across the following described property: (See Attached Exhibit "A"). <br /> <br />II. <br /> <br />GENERAL: <br /> <br />Park Dedi~tiQn, Park dedication shall be satisfied by the DEVELOPER <br />paying to the CITY the sum of One Thousand One Hundred Twenty and 0/100 <br />Dollars ($1,120.00) which amount represents 7% of the market value of the <br />lwo new lots being created which are Lots 1 and 2, Block 1. <br /> <br />Tree Disease Prev~ntiQn. The DEVELOPER shall prevent the introduction <br />and spread of tree disease into the residue tree populations of the Plat and <br />adjoining properties and reduce the impacts of construction on the residual <br />property of the Plat and adjoining properties. The DEVELOPER in order to <br />accomplish this shaIl: <br /> <br />install physical barriers (e.g. snow fence, string with ribbon, etc.) <br />around trees that are to remain (the barrier will be at least ten feet <br />(10') from the remaining trees; <br /> <br />bo <br /> <br />Insure that all equipment operators will have readily available tree <br />wound dressing and will apply immediately to damaged trees if wounding <br />occurs; <br /> <br />Insure that trees will only be skidded against other trees that are to be <br />removed. Trees in the middle twenty feet (20') of road easement will be <br />removed first, with remaining trees to be skidded toward the middle of the <br />road easement. <br /> <br /> <br />
