CASE <br /> <br />REQUEST TO REZONE THE PROPOSED PLAT OF TROTT BROOK PONDS <br />FROM R-1 RURAL RESIDENTIAL TO PLANNED UNIT DEVELOPMENT; <br />CASE OF GERALD BAUER <br /> By: PLanning Assistant Sylvia Frolik <br /> <br />Background: <br /> <br />Mr. Gerald Bauer is requesting approval to rezone the proposed plat of Trott Brook Ponds from R- <br />1 Rural Residential to Planned Unit Development (PUD) in order to develop the land with 83 <br />single family lots at least one acre in size in lieu of at least 20% of the land being dedicated to park <br />and open spaces. The average density of the plat is proposed at one unit per 2.5 acres. <br /> <br />On December 5, 1989, the Planning and Zoning Commission conducted a public hearing regarding <br />the request for rezoning. Following the mailing of the public hearing notices,/,,Ir. Bauer revised <br />his proposed plat to take in an additional 55 acres of property. City Staff has determined that the <br />Trott Brook Ponds preliminary plat and rezoning request will be subjected to a second public <br />hearing to be sure that all residents within 350 feet of the now Trott Brook Ponds boundaries will <br />have had an opportunity for input. City Code also <br />states that a Planned Unit Development shall provide a minimum of 20% for private or public open <br />space air recreational uses. In addition, if final plat approval is not ~anted within one year or if <br />construction does not commence within one year or in accordance with the development schedule, <br />the City Council may initiate a rezoning to what was in effect at the time of the initial rezoning to a <br />PUD. <br /> <br />R ecomm en dation: <br /> <br />City Staff recommends approval of the request for rezoning. <br /> <br />Council Action: <br /> <br />Motion to: <br />Adopt the Findings of Fact ~ <br />proposed plat of Trott Brook <br />Development. <br /> <br /> relating to Mr. Gerald Bauer's request to rezone the <br />Ponds from R-1 Rural Residential to Planned Unit <br /> <br /> <br />
